B1/B2 Visa Extension

Hello there,

I have a friend over from the UK visiting the US on a B1/B2 visa. His I94 is
stamped for 6 months (I understand this is the longest stay you can get on a B1/B2
entry as standard) but would like to extend that stay an extra 3 months. He is now
staying with us near Sacramento CA - has driven roadtrip from Florida! What process
does he take to extend his trip? I noticed form I-539 is unavailable on the IN
website at the moment - is that the one he needs? How far before his current date
of exit can he apply?

Here is what I have been told by others: He should apply about 45 days before the
expiration date on his I-94 card. You can find an I-539 form here:
http://www.lawsmart.com/documents/i-539.pdf. Do refer to the instructions on the INS
website about where he should apply for this and the filing fee, as the instructions
on the form may not be current. He should send in a COPY of his I-94 card with the
form, NOT the original I-94 card. He may not hear of his approval on the extension
while he is in the US, but should leave by the date that he specifies on the form
nevertheless. He should send a certified letter to the local INS office informing
them that he is leaving on schedule at the time he leaves the US, just to have this
documented for future reference.
