Anyone with a pot conviction granted a visa ?
 

This question is about trying to get a work visa if you have a pot
posession conviction (in my case 7 ago). I have applied for and recieved
a non-immigrant waiver to enter the U.S. (going on my 4th one). But I'm a
little concerned about having to wait 15 years from the date of conviction
to apply for an immigrant waiver to work in the U.S.-- as outlined in:

Section INA 212(a)(2)of the law.


All the other online sources regarding "INA 212(h)(2)" only have 2
options listed -- both spelling out that the only way the BCIS would
consider granting a visa was if the pot possession was your only
conviction, was under 30 grams AND at least 15 years ago.

A 3rd option, that the BCIS might grant a visa without the 15 year
clause, under terms of their discretion, only turns up on one site
(www.inadmissibility.com).

There are other things they take into account, like family who are
U.S. citizens or legal residents, but these don't apply to me.

If anyone has ever been granted a waiver under these or similar
circumstances, I'd love to hear about it.

Well, if you are going for a green card , then with a pot conviction
you have a serious problem, unless maybe you are marying a US citizen

if you want ot get a h1-b or other temporary visa then you are
eligible for a waiver, just as you got a waiver for your tourist visa,
although its a bit harder of course,..i would need to know a bit motre
about your case to say though..

It was 7 years ago; a gram of marijuana, and I was fined $200.

I received a Canada Pardon 2 years ago.
