If the new employer is that serious about waiting so long for you, perhaps they can look into an employment-based immigrant visa. You'd have to get married, but that way both you and your wife become US Permanent residents upon entry.

I agree with Noorah, get married and go for the Immigrant Visa.

Thanks for all the comments and help, it’s been very eye opening to say the least.

i wasn’t aware of the October 2020 part and the lottery situation so I may well get the ball rolling and use the 18 months to find a solution to the situation. Maybe marriage is the best/only viable option.

That's October 2020 assuming that you qualify for an H-1B visa, assuming that the company sponsors you for one, assuming that you are selected in the lottery and assuming that Congress doesn't pass any reforms to the current immigration laws between now and then.

There's a lot that could potentially go wrong (and an awful lot that has to go right) between now and then.

Getting married won't solve the visa issue - if it's an H1B, the employer is going to apply for, then you and the job have to have specific qualifications in order to be eligible.

Still better odds than the actual lottery mind. Go in eyes wide open - less chance of success than failure, but better than not applying but a margin.

My [firms] immigration lawyer just emailed to say that an H1b we had in the lottery was picked! 2nd year in a row it was submitted (may have been from the 20k for higher degrees) but fits those odds.
