221(g) H1B. Adminstrative processing. Experst Plss help.

Default 221(g) H1B. Adminstrative processing. Experst Plss help.

Hi all,

I had the interview for the H1B stamping today morning at the US embassy in London. My wife also came with me.. The visa officer was really helpful and she asked some basic questions to me and to my wife. She also saw my M.S. degree certificate, everything was fine. The interview was just for 5 minutes. After a while, the OFFICER SAID THAT MY APPLICATION HAS TO GO FOR AN ADMINSTRATIVE PROCESSING and she returned our passports. SHE HAS TAKEN ALL THE ORIGINALS LIKE MY I-797, MY DEGREE CERTIFICATES, TRANSCRIPTS AND OTHER DOCUMENTS SENT BY MY EMPLOYER.

So EXPERTS, I have some doubts:

1. How long they take to check to do the Admisntrative Processing?. We hold an Indian Passports with British Degree.

2. What are the chances of getting the Visa?

3. What excatly they do (in the Adminstrative process)?

4. Will they call my previous employers in India?? My project manager is changed, and I dont know who will give my reference!!!

5. Is this very serious matter, or very dangerous?

6. Will they return my orignal paper after the adminstrative process??

PLEASE HELP ME.... I AM IN THE DOWN, FULL TENSION.. I HAVE TO VACAT MY APPARTMENT AFTER ONE MONTH.....

I APPRECIATE FOR EARLIEST ATTENTION..

It depends what they're doing. By far the most common thing these days
is a security check to make sure you are not a terrorist. Security
checks can take a long time - there have been cases of it taking more
than a year, but I believe it's usually a few months now.

High, as long as you are not a terrorist.

Don't know.

Unlikely.

It shouldn't be a problem, but might take some time.

So how many months should I consider to get the reply from the embassy, approximately.

And I dont have any police records or anything. I am clean law abiding... will there be any other problems....

Hi,

The good news is that it could only be a couple of weeks before you hear back. The not-so-good news is that it could easily be months. Unfortunately there are no real hard and fast answers to this. Check out the message board for US Marriage based visas and do a search for "Administrative review" or "Administrative processing" as they seem to encounter this a bit more frequently. It might give you a better idea as to what exactly is going on at the moment and how long you are likely to be waiting.

As to why you are being checked out is anyone's guess. Most likely your name matched a name on their watch list and they need to makke sure you are not that person or, perhaps the job you are being brought to the US to do somehow raises flags for them.

Hi

We have been waiting 14 weeks so far for our additional administrative processing on a L1a visa application, I to have a clean record but i dont think there are any hard and fast rules regarding it, but i am no expert I am just like you, waiting for someone to determin my future.

Hi Ashok,
Don't worry i saw 3 cases exactly similar to urs.It took exactly 1 month for them to clear administrative processing.
once it has been cleared they will send u a visa issuence fee,
u can pay and get ur visa stamped. so don't worry,

Thank you very very very much for your reply. I came to unversity all the way from whetstone to Hendon to check the forum as my internet and laptop are both down..

Impossible to say. I heard of one case that took 15 months, and
others that took over a year. It appears that recently they have
usually got much faster, perhaps a month or so. It depends on
just what they're investigating and how thorough and efficient
they are. You should expect to get the visa, but you would be
wise to make no assumptions about when.

Assuming this is a security check, and assuming you are not a
terrorist suspect, there should be no other problems.

HI Cool,

No, I havent received any letter from the US embassy yet. I am still waiting for the clearance to come...

And, yes, when did you applied and where did you applied? What visa you applied for? Also, what passport you hold...?

Dont worry these type of cases are taking something from 1 months to 18 months. So prepare to wait for a long period..

Please reply so that we can know each others experience.

I applied H1B visa on June 2,2004 here at the US embassy, London. I am still waiting for it. I contacted the Embassy and all they say is that my visa application is still in process....

When did you applied for the H1B visa and what passport you hold. Are you a British Citizen or what....?
