A good definition of a frivolous lawsuit! Their hours weren't effected, the customers could still get there, the ark itself wasn't damaged, and unless they had landslide insurance I don't see how the road was covered. Call it an Act of God and charge the rollers for the court costs and legal fees. If the judge goes to the same church as the would-be Noah, on the other hand, there could be a problem.

I myself got into a discussion on the phone with my bank over whether I needed flood insurance for the bank to be compliant with federal lending regulations because a "federally defined flood zone" cuts across the rear of my property, and the edge line actually cuts through an outbuilding. Having looked at local county maps which on the phone with the bank loan administration department, I assured them that the building in question was currently in the process of being demolished. All that said, the flood line at that point is around 15'-20' above the road at the bottom of the hill, which in the last sixteen years hasn't had any history of standing water, much less anything that amounts to a "flood", even after rainfall of 10"-12" after a tropical storm (post hurricane) has blown through the area, in the last 16 years that I know of, so heaven only knows what sort of storm/rainfall would be required for my property to be affected by flooding.
IME. Flood insurance is always an add-on at extra cost, so determining if you are covered is usually a cut-and-dried matter (pun intended).

Maybe if the cretins and the protesters weren't permitted to carry guns less police would have been needed? Better over-prepared than under. Anyway, no one was murdered or injured so that's a plus
