Matter of Kane is a mother case on the subject.

I had assumed she was a USC and that’s how he got his GC. But Indian citizens can’t have another citizenship. So he must have got it though work.

I have known people who have done the same, doing quick trips within every six months, maintained a property or had relatives put bills in their name, and paid from a bank account with the GC holder name on it etc.

As far as tax returns GC holders can, and usually do if abroad, file as residents yet still get the foreign earned income exclusion ( I have a relative who in consultation with both his immigration attorney and tax specialist did exactly this) there are different tax forms for a non-resident. It would be interesting to know whether Sunak filed as a resident since he held a Green Card, or as a non-resident, considering the US-UK tax treaty- and in his wife's case whether non-domicile status. If for example he filed as non-resident technically border control could deny him entry. Plus there is a potential 'exit tax' if a permanent resident gives up residency after a period of time as a resident. One can assume crafty Sunak and his wife had all the legal firepower and contacts to handle things legally.

They both got Green Cards through their US employer(s). What's still unclear is whether she surrendered her Green Card when he did.

Does anyone know when he moved back to the UK? He was elected as an MP in 2015 so how was he maintaining residence in the US until last year? Summer holiday to California every year?

wow that must have been a big tax hit for her based on the story.. maybe she was not getting the dividends at the time… that would also have been an interesting FBAR… sure there will be some IRS geeks going back over her tax returns now…
