Am I being misled?
 
My company (or rather my boss) has told me that they are willing to progress a L1 visa application for me to move to the USA. I have been told that it is 'in the hands of an attorney' and this was some weeks ago - I have read up on the procedure that has to be followed and am thinking I should have heard something, at least, to indicate that the I-129 petition has been filed (not least a request for some information regarding my specialist knowledge).

Should I be worrying?

"in the hands of the attorney" could mean the attorney is still drawing up the paperwork. Perhaps you can contact the attorney directly?

Having been through the process I can only tell you that the attorney would need to ask you a bunch of questions before anything could even come close to being filled. Have you talked / corresponded with them at all?

you need to check out with your company again, and the attorney too in order to get the clear idea about your paperwork, and till what it will go?

first step for us was getting a big packet of info from the lawyers with instructions on what to fill out and return. how fast you get it back (and how complete it is) will alter the timeline.

I would have expected the attorney to have contacted you by now. Ask your boss to follow up with the attorney to make sure that nothing has fallen off his desk!

Always keep in mind that the attorney works for the company, not for you. If there's been a delay, it could be because that's what the attorney was told to do.

Or the company has delayed in getting in touch with the attorney. Or the attorney has said "thank you, here is our invoice."

Or the attorney was on vacation. AILA just had a Mid-Year meeting in Costa Rica.

Hmmm, thanks for all the replies. I have asked for the contact details for the attorney - I hope its something simple but I would also not be that surprised if nothing had actually been done at all!

After some more investigation it appears that the Attorney is handling a blanket visa petition for the company, which is why, I presume, that nothing specifically for me has been done yet.
