Default Ruth Bader Ginsburg

I feel she deserves a goodbye: Ruth Bader Ginsburg has died. A great advocate for women's and minorities rights, an eminent lawyer with a brilliant mind, second female justice to the Supreme Court. If you haven't seen the documentary about her you should watch it.

On the bbc world service last night they had a program about her quite interesting.I did not no that when elected to the supreme court it is for life.It will be interesting to see the political fighting over the next person to be elected.I did not know nothing of this lady but it seems she was very well respected by all.

There will be nothing Democrats can do to prevent the court tilting 6-3 at this point.

SCOTUS decisions are about to take a hard right for the next 30 years

And in many cases reactionary, rather than conservative in the true meaning of the word.

In a very true sense she battled for gender equity.

Two republican senators have said they will vote AGAINST any attempt to have a replacment voted on to the SC until after the election results, and if trump loses until after inaugeration. That is enough to derail any attempt.

Uh no it isn't.

There are 53 Republicans, and Pence could break a tie.

So 4 would need to break ranks.

A simple majority is enough for conformation.

I can't see it lasting 30 years, if they ban abortion I'd be amazed if someone doesn't have a go at killing them.

After being treated for pancreatic cancer you might think she would have let Obama appoint a replacement instead of trying to outlast Trump who might well carry on another 4 years. She would then have been 91 years old at the end of a second term. If I was a boss I wouldnt be tempted to employ anybody who was 91 years old.

I heard an interesting comment last night that nowhere is it enshrined in the Constitution that there should be nine justices. It would be perfectly legal for a future Democratic administration to address the balance by adding more justices to the Court. That said, it is utterly disgusting that the current administration is making political hay out of the death of such an accomplished woman, who has contributed so mightily to the history of her country. They were up in arms about Obama nominating a justice with nine months left in his administration. Now that is all out the window and they want to rush through a nomination in a matter of weeks. They have no class or ethics whatsoever.

If Trump does get to appoint a loon, and Biden wins in November, what are the chances of Congress expanding the number of judges on the Supreme Court? (low I would think, but it should be attemted, Trump has ripped up the rules of precedent)

Edit: Nutmegger, we posted more or less the same thing at the same time, it is the Zeitgeist of the moment

Court packing might feel good in the moment, but all it actually means is that the next time the Republicans are in power they will do the exact same thing. Then SCOTUS just becomes an actual extension of the election.

That's not a good thing for anyone.

It isn't. But otoh, McConnell's action in '16 in blocking a vote on Garland has already turned the Supreme Court into such an extension. So if the Democrats ever do control both houses and the presidency, I'm all for adding Supreme Court seats, especially if McConnell rams through Ginsburg's replacement. Such actions have to have a forceful Democratic response.
