I have just sent it, look to the top right hand corner of the scene under Welcome denise1488

If your mother has no will then the property in Spain will automatically go to the children.

It is very important that she does make a will in Spain as the legal process without one is very slow and complicated.

The number I gave you was for Chiclana - Costa de la Luz but if you ring them I am sure they can give what advice you need over the phone. Also Fred is very very good with the advice he gives so be rest assured if Fred says something then it is usually correct.

the trouble with getting a will written now is my mum is bedridden and doesnt really know what is going on around her she doesnt even know what day it is due to her illness and medication so i dont think it would be possible

Denise this is a terrible situation and I do feel for you. It happened to a friend and her father re-married and then died within six months and his widow got everything and the children nothing. Can you get a Power of Attorney in Spain?
That would then allow you to deal with her affairs. Good Luck to you.

If shes not capable of signing a new will, then its unlikely she will be able to sign a POA, although its certainly worth a try.

I'm afraid yet again it underlines the importance of drawing up a will.

On the bright side, Fred has advised that the estate will go to the children, but I guess that could take a long time.

When someone passes away in Spain, as in the UK, bank accounts will be frozen and any property will not be able to be sold. Inheritence tax has to be paid of course.

I do hope you manage to sort something out on your visit ... Good luck.

I am not sure about Spain but certainly in England neither would be valid I'm afraid.

Having just started work in a lawyers' office I can tell you a lot of our work is preparing Spanish Wills and I cannot impress on people how important they are and the horrendous problems that are encountered if Wills have not been made.

We have recently bought an apartment near Albir and wondered if anyone could recommend a lawyer nearby to draw up a will for us as soon as possible. Seems this is very important having read all the informative and sometimes worrying posts. Thanks in anticipation
