When is the latest to apply for residencia under the current rules?
 

Hi all,

Following on from my previous post, does anyone have a definitive answer as to when the latest we could apply for Spanish residencia is and still be under the current rules?

Do we have to have residencia by 31 Dec 2020 or have applied for it by then?

Can I suggest a modicum of common sense in that "This is Spain" we are talking about - the mañana syndrome means you need the paperwork as soon as possible and leaving things to the last day is not clever, quite the opposite.

Unless there is a unknown reason, I would aim to get the paperwork by the end of September at the very latest unless it really is impossible

According to the Withdrawal Agreement, you must be resident on or before 31st December, but application for residency can be made up to 30th June 2021.
'You and your family may need to apply for a residence status to confirm that you were already resident in the EU country you live in before 31 December 2020. You will have until at least 30 June 2021 to do this.'

This is stipulated in the binding Withdrawal Agreement, but I cannot find specific mention of the June date in Spanish government publications.
BTW, EU citizens in UK have 2 years after the end of the implementation period to register their settled status.

Thanks all as current thinking is to start the residencia application process in about Nov this year when we get there. Then am hoping the will then get residencia and not be liable for any possible Spanish tax this year.

My latest information is all foreigners' department offices, either standalone or within police stations, are closed to the public and no face-to-face application for residency can be made during the lockdown - you can't apply online. You can make an application for appointment online, as you should, but dates offered are from September onwards. It's likely that there will be a big surge in demand once the lockdown is over and offices reopen, so I would get an appointment sooner rather than later. You may find it easier to get in touch with local gestoria in Spain and ask their help in application, as they can book an appointment for you and tell you about exact documentary requirement specific to the particular office, as you need to get them ready while you are still in UK. Expect to pay around 100 to 120 euro per person for their services.

I heard of at least one couple getting residencia through Alicante during the lockdown.

Well we can't do anything yet as I have been told the national police stations in gran canaria are not open for nie applications etc, even if we could fly out!
