Default Very late payers of community fees

I noticed this on another board and we have a similar problem. Does anyone happen to know the costs incurred?

I have just received the agenda for our community annual meeting. One owner has paid nothing for his garage for 4 years. Amount over €800. Another has never paid his annual fees for 5 years and owes over €500.

my question is this. When does it become worthwhile (financially) to start issuing solicitors letters and court proceedings.

Naming, shaming and letter writing has produced nothing.

I am interested in anyone who has a firm, practical and based on experience idea of what the costs are, and how much we should therefore put in the budget next year for legal fees.

Someone on our urb owes over 4,000 € and no one seems able to make them pay up.:curse:

But when does it become a large enough debt to bother going to court?

Our Admin asks our approval in every annual meeting to take action against anyone outstanding for more than 3 months, generally they get paid then but if you leave them to mount up then you will find people can generally not pay up, if you get on the ball with a lawers letter when the amount is small then they generally tend to pay.

The president can start proceedings against them for payment, interest and costs.

I have no Idea, but when they read the minutes and got a letter about taking action from the president they soon paid up.
I think they can have the apartment sold to recover the debts.

At one place we rented, there was a list of debtors, some owing three years fees. The worst were annotated with comments that legal action was underway, these were debts of €3000 or more.

Being a bit green Mike ,
Do the other members of the urb then have to find more money for the upkeep and insurance etc.

Yes, all the money goes into a general kitty so without their payments the kitty is low and effects it if decoration or repairs were needed.

So do the ones that pay regulary ,become liable to pay the non payers share, or are asked to, or does the urb become run down and repairs not carried out eg if urb half empty not a good sign then

Well no one miraculasly steps in and pays the things that need to be paid that cannot be paid because there is no money, so....

1) Either the community do not pay what they cannot pay and eventually action will be taken again ALL the owners.
2) The monthly community charge is put up or extra payments are made to cover the outstanding monies that are needed.

If there is 3000 euros in outstanding debts and say 3000 is owed then it is the responsibilty of remaining community members to pay it and/or make sure the money is available to doso.

There are people here who leave the community fee for a month because they are tight that month or just can't be bothered paying it, then the next months comes along and the same happens, eventually the amount gets to the stage where the property owner just can't pay it (in one go) and so just leave paying altogether. If these things are not jumped on when the amount is small it can very quickly become a problem for other community members. Some admins don't even bother to ask as there are a lot of these companies like some lawers etc. who just take the money but make the right moves.... so basically say hello, smile and do nothing. Don't let this get out of hand, make a suggestion at the next community meeting or go to the president or the admin yourself and stress your concern, then if you don't get a response within a month go back and ask what is being done.

Ok this is what i plan to insist my administrator does. I will be president at the next AGM in April

1. Immediately add interest to the amounts outstanding of 10%
2. Issue a community wide letter stating that fees will be doubled for 2009 but a 50% discount wil apply to anyone paying within 2 months.
3. Arrange meeting with lawyer to start proceedings.
4. Find out timeline for when we can auction properties to recover debts.

Does that sound about right?
