Urbanisation/Community
A number of years ago we purchased a detached villa on a newly constructed site, the developer building around 200 detached villas with pools.
Thankfully all licences are in place and everyone on site has got their escrituras and have been connected to mains electric and water.
To date, we have not paid any Council Tax. We have now been informed, verbally, by the Town Hall, that the area which we live is an 'urbanisation' and that owners are responsible for road maintenance, lighting, street cleaning etc and that a President, Vice President, Administrator etc. has to be appointed to oversee the community.
My question is, does anyone know if a Town Hall can legally just decide that an area is a ´'community'. There is nothing to stipulate this on our escrituras and we only own the actual plot where the house is placed, not a portion of the general areas or roads. There is no golf course, swimming pool or communal areas.
Obviously none of the owners are happy about this and all assumed that they were purchasing an individual villa with responsibility passing to the Town Hall for the general maintenance on completion.
Any advice or clarification would be greatly appreciated.

Luckily our place was taken by the Town Hall, but the net result is that our roads are not up to scratch. The plus side we dont pay Urb Fees, but pay just €400 property tax.
However its a bit unfortunate for you, because you have no idea what you are going to be stung for per year. As you can imagine all this infrastructure is going to cost a lot to maintain ......... and its only going to be split 200 ways

Thank you for your replies and the link to more information.
What I cannot understand is we do not own a portion of the infrastructure. We owned, in the past, an apartment, which clearly stated that we owned one 30th of a swimming pool, gardens etc which therefore we had to contribute towards the upkeep.
With the villa we do not own the roads or general areas, but surely they must be owned by someone???
One further question, do you know if we still have to pay IBI, and if this will be at a reduced rate.
