UK born child returning to UK for education
My son who will be 16 in a year wants to return with me to UK to complete his education but my ex is refusing to let him go. We live in Spain and my son studies at a Spanish school he is bilingual. He was born in Scotland and came to Spain when he was 10. Firstly, can his mother prevent him leaving when he is 16? Secondly would he be eligible to entry secondary school in Scotland? Thirdly if he had to return at 18 would he be eligible as a home student under scottish law?

Ok should have done this first before posting. Just looked at the Scottish Education website and I see my child would not be subject to international fees if he returned to uk for university as I am a UK national as is he ,plus we lived in Scotland prior to leaving for Spain so that qualifies him as a home student. However I would like him to return at 16 to do Scottish Highers and the question is can he make that choice to live with me in Scotland?

An interesting, albeit sad situation. As your Child was born in Scotland but educated in a Spainish school since age 10, it isn't too clear if your ex is Scottish or Spanish nationality. Perhaps you can clarify as it could be significant to the circumstances and ultimate ruling.

So do you currently live in Spain or Scotland?
