Traffic laws
 

Wonder if anyone knows the answer to this

My son was out on his scooter last night. There was a procession in town that finished at 9:30pm and so all surrounding roads were closed.

At 11:30 he needed to put his scooter away in our cochera. The barriers stating no entry (red disc white line) were still in place so he pushed his scooter past them to the entrance (there was no other way to get there and he didn't want to leave it out on the streets).

Two local police then stopped him and gave him a ticket for 40€ because he should not have pushed his scooter past the signs!

Is this correct or has he a case to argue?

I'll probably go down and discuss it with them on Monday but just wondered if anyone new the law.

Technically they were right and son was in the wrong.
Having said that, their actions would be unreasonable in the circumstances that you describe and I can't imagine why they would have taken such a heavy handed approach.

Jobsworth. You might as well pay.

This sort of thing drives you mad when for example you can sit in a café and count around half the passing drivers on hand held phone or even texting plus no seat belt as apparently that is optional until you leave the town limits. Yet no one tackles that. I suspect it was near the month end and a target had to be met.

Here is a rhetorical question. If the policia forgot to remove the barriers , how long after would you be able to pass them ? Three in the morning, Eight next morning, a week later?

Where we live it is standard practice with maybe 2 in 5 not wearing a seat belt.in town. When I tackle Spanish friends they shrug it off as not necessary and it is "optional". It wasn't meant as a joke just a reflection of inland attitudes. Same as parking on zebra crossings, leaving engine running with no driver, driving in the middle of the road on blind corners - in fact everywhere.

It’s not a new law. The police are always looking for the easy fine, they are financially driven everywhere.
€40 you just need to put it down to experience.
