TAX REGULATING THE RATE BY DRIVEWAYS THROUGH THE SIDEWALK

Any owner of Costa Esuri, can be surprised in a few days by a new tax that the city of Ayamonte has launched.

That is, you must pay for having access to the sidewalk to his private plot in Costa Esuri, likewise the Intercommunity or Communities that have equal access.

They are required to pay the fees imposed by this Tax Ordinance, the persons or entities to whom the licenses are granted, or who benefit from the use, if we proceeded without proper authorization.

It is clarified that although we must ask permission to do so, the Council to be imposed on owners who even if they have not asked, if you enjoy this access.

You may want to also collect the tax by previous years, since the entry into force of the ordinance.

Well, this ordinance does not fit, as the streets and sidewalks of Costa Esuri, unless the Council confirmed otherwise, have not yet been received by the Council , so apparently the owners of these streets and sidewalks are owners fplots, apartments, etc.

It would be illogical to pay for spending what is one, and over someone who is not the owner or responsible for it, or maintenance, etc.

Today I asked the question in the corresponding service of the Council, and they have confirmed to me that if the path has not yet been received by the Council, and therefore neither maintains nor preserved, has no logic that intends to charge that fee . They have indicated to me that we must submit a written denouncing the act, explaining that the Council is not the owner of the street, and annulment of receipts and payment orders.

Me ha n indicado que se presente un escrito, denunciando el hecho, que la calle no es de titularidad municipal y solicitando la anulación de los recibos y ordenes de pago correspondientes.Mas complicado lo tendrán aquellos, que tengan domiciliados estos pagos, porque ya saben Vds. que pasa para recuperarlo. Se adjunta la ordenanza.

I have just received this bill. From Servicio de Gestión Tributaria , Huelva.

The document on the Ayuntamiento's site talks about "vía pública" does that mean the Ayuntamiento is taking responsibility for the Costa Esuri roads? And what is the the significance with regard to EUC. Or am I getting carried away?

Yes you are, the Ayuntamiento has definitely NOT adopted the highways. Indeed the roads are deteriorating at a faster rate and the condition is now dangerous in places, the viaduct on the access to Esuri has an enormous pothole. Many roads do not have street lighting since the cable has been stolen or the bulbs have failed. None of this is being attended to by the Ayuntamiento or the EUC. ALTHOUGH WE MUST HAVE THE BEST MAINTAINED BOULEVARD GARDENS IN HUELA PROVINCE. All this and we pay about € 1million every in EUC TAXES. For what?

The question we ask in complicated.
First explain that the Tax Management, whom the City Council gave the collection of fees on their behalf, is like an infernal machine. Not listen to reason. That is why the City Council granted it.

I do not have a receipt for those who have sent, but normally specify the period in which you have to pay, and if not start charging extra.
Sometimes it indicates a deadline for lodging an appeal.

Regarding the question on the EUC, by statute, it is responsible for maintaining the local road network. See SECTION 5, 1 A. That's not supposed to have to pay for this tax.

Unfortunately I understand that in principle you will pay, but should mandatorily submit a written at City Hall, with a copy to the seal with the date of our delivery, and deliver us, as a justification for our delivery.

And now waiting for someone to answer, and if possible spend every quinde days by the City to ask how is the issue, and if after a month, request a meeting with the Mayor.

In Spanish should say: Sr. Alcalde de Ayamonte.ASUNTO: Tasa por Entrada de Vehículos.Mr............................................, con propiedad en la calle..........................., urbanización.........................de Costa Esuri, y domicilio a efectos de comunicación en ...............................EXPONEQue ha recibido la comunicación para el pago de la tasa por Entrada de Vehículos en mi finca anteriormente descrita.Que a mi entender e información, las obras de Urbanización de Costa Esuri, no ha sido recepcionada por el Ayuntamiento.Por ello, no tiene ninguna lógica, al no ser vías públicas, el que el Ayuntamiento, quiera cobrarme por una Tasa sobre algo, que ni es de su jurisdicción, ni mantiene.Es por ello, RUEGO a Vd, de instrucciones para que se proceda a anular la orden de cargo.Atentamente

I think I am probably the first to have followed up the notice and being domiciled have paid since once you have given the tributaria your bank account no. if you miss a payment they have the power to freeze your bank account. That can lead to all sorts of problems with the utilities if they then don't get paid. They are demanding back payments for three years from 2013 @ €9.95 pa. plus of course €9.95 for 2016 when it falls due. I was told the charge was in case I caused damage to the footpath and the council had to carry out repairs which, looking at the state of the paths with tree damage and concrete heave, is laughable.

I believe this tax is based on National Legislation concerning VADO PERMITE which is designed to give clear access 24/7 365 to your gate. No one not even the OWNER of the house can park outside the gate. You see the yellow plate with a red roundal on garage access to apartment blocks in dense urban streets.

I am taking the liberty of tidying up Alberto's post to make the translation clearer and apologise for taking the liberty.

Perhaps in four ot five years more I will speack better.You are right, but ussually it happen when the streets are public streets, bur in our Costs Esuri, the streets are not in the hand of the Council, so they are not repair them.I am going to write the Ordenance.ORDENANZA FISCAL REGULADORA DE LA TASA POR ENTRADAS DE VEHÍCULOS A TRAVÉS DE LAS ACERAS Y DE LAS RESERVAS DE VÍA PUBLICA PARA APARCAMIENTOS, CARGA Y DESCARGA DE MERCANCÍAS DE CUALQUIER CLASE.
Artículo 1º . Fundamento y naturaleza. En uso de las facultades concedidas por los artículos 133.2 y 142 de la Constitución, y por el artículo 106 de la Ley 7/1985 de2 de Abril, Reguladora de las Bases de Régimen Local, y de conformidad con lo dispuesto en los artículos 15 al 19 y el artículo 20 apartados 1 y 3.h) del Real Decreto Legislativo 2/2004, de 5 de marzo, por el que se aprueba el Texto Refundido de la Ley Reguladora de las Haciendas Locales, este Ayuntamiento establece la tasa por entradas de vehículos a través de las aceras y la reserva de vía pública para aparcamientos exclusivos, carga y descarga de mercancías de cualquier clase, especificado en las tarifas contenidas en el apartado 2 del artículo 3 siguiente, que se regirá por la presente Ordenanza.Artículo 2º . Obligados al pago. Están obligados al pago de la tasa regulada en esta Ordenanza las personas o entidades a cuyo favor se otorguen las licencias, o quienes se beneficien del aprovechamiento, si se procedió sin la oportuna autorización.Artículo 3º . La no presentación de la baja determinará la obligación de continuar abonando la Tasa. Artículo 5º . Obligación del Pago. 1.- La obligación de pago de la tasa regulada en esta Ordenanza nace: a) Tratándose de concesiones de nuevos aprovechamientos de la vía pública, en el momento de solicitar la correspondiente licencia. b) Tratándose de concesiones de aprovechamientos ya autorizados y prorrogados, el dia primero de cada año natural. 2.- El pago de la tasa se realizará: a) Tratándose de concesiones de nuevos aprovechamientos, por ingreso directo en la Tesorería Municipal, pero siempre antes de retirar la correspondiente licencia. Este ingreso tendrá carácter de depósito previo quedando elevado a definitivo al concederse la licencia correspondiente. b) Tratándose de concesiones de aprovechamientos ya autorizados y prorrogados, una vez incluidos en los padrones o matrículados de esta Tasa, por años naturales en las oficinas de la Recaudación Municipal en el primer trimestre. Artículo 6º.- Infracciones y sanciones. En todo lo relativo a la calificación de infracciones Tributarias, así como de las sanciones que a las mismas correspondan en cada caso, se estará a lo dispuesto en los artículos 178 y siguientes de la Ley General Tributaria. Disposición Final. La modificación de la presente Ordenanza Fiscal fue aprobada definitivamente, por el Pleno de la Corporación Municipal el 20 de diciembre de 2.013, entrando en vigor el 1 de enero de 2.014.

Thanks Alberto. So it it as I suspected it is related to National Law first passed in April 1985 and updated in March 2005.

However it is clear that you can only apply this law to highways that have been ADOPTED by the local authority in our case Ayamonte. Therefore it cannot and should not be applied to Esuri.

I shall certainly be sending your form letter to reclaim my €30 and stop further payments. It is outrageous that it now costs me almost €2000 each year to own a property with all the various payments to the town hall/EUC. For this we receive almost no services directly. The roads are NOT maintained, the street lights do not light, we have no connection to main drainage (Fadesa laid the drains to high), our bin arrangement are not complete and have only just appeared after 7years, our verges are not watered or cut, most of the street trees are dead for lack of water the list is endless!

What makes it most painful is that I understand from those that know I pay between 1/3 and 1/2 more than a similar Casa Individual in town which also gives them a proper bus service and a host of other advantages, police, TH admin, doctors and clinic, fire station (when our house was under threat from a grass fire it took 45 mins to arrive). All of these things were in the original promotion from Fadesa to be placed on site S1. In addition there were many sites set aside for sport and schools non of which are anywhere on the horizon.
