Default spanish law and spanish litigation

12 Months after a bad fall,due to no fault of my own in a hypermarket in madrid in which i busted both knees,i am still unable to find a lawyer worth his onions,can anyone steer me towards one SOB who is capable of fighting his clients corner,no cure no pay,seems to me that the lawyers only interest is their own self interest,after countless expert opinions ,hospital visits ,xrays,denuncias ,im no further advanced in seeking a just conclusion to this predicament,namely monies to pay for the op,it seems the hurdles just keep getting higher.im interested to hear any body elses experiences in a similar situation in spain.

Here's a good lawyer who knows his onions give him a ring.

Check out your household insurance cover, a lot of them have legal representation included in the cover.

You know, not a lot of people know that in England - where it is very common to have legal cover.

I didn't know that it is common with Spanish household contents policies.

If it is anything like in the UK the main problem is you rarely get to choose the solicitor you want, you have to use the insurance providers pet firms all the way up to issue of proceedings.

As far as no win no fee is concerned, I cannot see why anyone expects a solicitor to take on a case on that basis unless the prospects of success are high.

Also do not think just because their is a policy in place the claim will proceed - the solicitor's advice to the insurers has to remain positive or the plug will be pulled by the insurer. Another small print issue is that many policies restrict how long you have to seek to take up your rights with the insurers (commonly 6 months from the negligence)

Sadly as you are finding out the legal system in Spain is fairly poor for support in most cases, you will spend a lot of money and be very lucky to get anywhere... at least that is what I 'and others I know' have found over many years here. I have used 4 lawers here on several occasions and not one has done what they where supposed to do with anything, even with a simple contract the lawer couldn't even get right. You also need to sit on them * constantly * to get them to move on something, but again that is generally the Spanish way.

I don't like it when people at fault get let off, especially when they 'or as companies' are ripping people off but unfortunately that is what happens here in many cases, the only thing you will have to show is a big hole in your pocket.

I am sure not all lawers here are useless but I have not yet seen anything to prove any different... but that is Spain.

Very true, dont hold your breath , I`m still waiting for the return of a depost on a house from six years ago, it went to court two years ago and I won but have not recieved a bean yet!!!
