UK Gov just issued this -

Official information British people moving to and living in Spain need to know, including EU Exit guidance, residency, healthcare and driving.

I find this sentence from the new website very worrying indeed:-

"British citizens who are resident in Spain before the UK's withdrawal date (29 March 2019) will be subject to the general immigration regime. In other words, British citizens who are now residents as EU citizens will be subject to the regime governing citizens of a third country. "

This seems to say that even those of us who were registered as residents prior to 29th March 2019 are going to be subject to the regime governing citizens of a third country when applying for a TIE to replace our current registration certificates - including the minimum income requirements, currently €26,000 per year for a single person and €31,500 for a couple. There will be many current British residents in Spain who will not be able to meet that threshold, therefore are their rights to continue living here going to be threatened?

You are either a EU citizen or you are not. After Brexit you will not be an EU citizen. Obviously there is a different set of rules. If you are already a permanent resident or a “less than 5 year” resident, duty registered, then the only formality with be to change your current permanent residence certificate for one applicable to your new non EU status. Hopefully that means that they will issue us with proper residency card.

The income rules etc only apply to new applications. What those rules will be for ex UK applicants have not yet been decided, but they should be broadly similar to the rules for foreign applicants in the UK.

Although that isn't spelt out in the section on Residence on the new Spanish Government website, those are the minimum income requirements for third country citizens applying for non lucrative visas.

I had previously believed the same as Fred James about the position of UK citizens who had permanent residence prior to Brexit, but this sentence from the new website says, I repeat-

"British citizens who are resident in Spain before the UK's withdrawal date (29 March 2019) will be subject to the general immigration regime. In other words, British citizens who are now residents as EU citizens will be subject to the regime governing citizens of a third country. "

That is not talking about new applications, it specifically refers to those who are presently resident as EU citizens.

That is not talking about new applications, it specifically refers to those who are presently resident as EU citizens.
There is no point taking that sentence out of context!

It then directly states -
All British residents in Spain will be considered legal residents in Spain.
and
To facilitate documentation of all the British citizens in Spain, the registration certificates and cards of family members of EU citizens will continue to be valid until the issue of new documents under the general immigration regime (TIE cards)

It then states at the bottom about gaining residency now if you have not done so already - " In the case of an exit with an agreement, the certificate will allow you to prove your condition of beneficiary under the Withdrawal Agreement. In the case of an exit without agreement, this document will allow you to continue to reside in Spain and obtain the documents required by the immigration regime. "

You NEED the residency certificate to be able to obtain the TIE card later!

I agree with Smithy and it is all quite logical those that are here and arrived as EU citizens and have legally registered etc will have rights that those arriving after final cut date won't because they will be arriving from UK as non EU citizens.

The message is if you have not already registered as a resident do so now so as to accrue your rights. I hear the Alicante area is overwhelmed as all those that have been living under the radar are now crawling out to register.

Just re this people need to also be aware that if they go to make their residencia permenant after five years, which although from this is not essential, they are now asking for proof of income tax payment or declaration for the five previous years! This will help spain flush the tax dodgers out no doubt.

Interesting. I guess it would be too complicated for the Hacienda to compare the list of foreigner residents with their list of foreigner taxpayers!

You would think they would but separate departments no doubt same in UK. Mind this way no need to pay for expensive software when you can let the fear of brexit do the job for you.
