Hi can anyone recommend a good english speaking solicitor, (in Spain) that could assist us in getting a copy of a spanish will.

You will need to say an area in Spain so that people can provide recommendations.

My FIL lived near Velez Malaga, and passed away recently, and we have been trying without success to obtain a copy of his will, so need a solicitor who could assist on our behalf.(so any area nr there I suppose)

We was advised that my husband would need to go to the notary to prove who he is, but we live in Australia, so really need some advice on what we need to do.

I remember from previous posts that you have issues with your FIL´s wife and this is why you need a copy of the will, is there no way that you can overcome these difficulties with her in order to ease the situation. My understanding is that inheritees need an NIE number as well but the notary will advise you on this and how to get one with you living so far away. Cannot personally help with recommending a notary but hopefully someone will be along who knows the area and will give you some names.

they can get a NIE from the Spanish consulate in Aus - the rest, I don't know

Yes it is simple, quick and cheap to get the NIE from a consulate. I also understand that you can search the central wills register in Madrid without using a Abogado (Spanish Solicitor). It may even be possible to do it online but I would guess you would need the NIE and a good reason just like you can get a Nota Simple from the Cadastral just need to have a reason.

If a Spanish will was written then it must be registered in Madrid if not then all that is left is to dispute under the Spanish "forced inheritance rules" and that could be very expensive.

This is where the crunch comes for some people. How much money to throw at something that may end up gaining very little.

Yes there is a spanish will, but have been unable to find or contact the central wills registry in Madrid, to see if we could obtain a copy without going through a solicitor.

Try http://www.decottalaw.com/ ,Ive heard they are expensive so get a written detailed quote :eek:
