To sell a property is there a way to stay for longer than 90 in 180 days?
We are thinking of selling our property and feel we may need longer than the 90 in 180 day limit. Does anyone know if it is possible to stay longer in these circumstances?
Any advice would be appreciated.
Thanks

If you are UK passport holders then you will have been stamped entering Spain. If you leave after more than 90 days you will face questions from Spanish immigration. The result could be a fine or a ban etc. You cant really stay longer because you havent sold a property. Obviously you can get a property ready for sale and normally you wouldn't need to be in Spain as your agent would arrange viewings etc. You would only need to return for the final formal sale.

I agree with Ronnyone that selling a property is not a valid reason to "overstay". You could get confirmation from the Spanish consulate in the UK.

You can apply for an extension for a very small number of reasons and each application is taken on its own merits.
One of the exemptions is 'important personal reasons' but IMHO a pre planned property sale would not fit this, it would usually be something unexpected delaying your exit, although there is no official definition of what an important reason is.
If it were me I would prep the property for sale, leave it with an agent then return closer to the formalities (as has been suggested above)

I would think the only acceptable reasons considered for overstaying would be illness or accident (such as during covid people unable to travel back to home country) or being in the position of accompanying someone who you are responsible for affected by the above. I would guess one knowing in such circumstances they would potentially overstay they would need to have that formally authorised?

Generally, any overstay would have to be for an unforeseen event.
The selling of a dwelling could not be considered as unforeseen.

I think the OP may be thinking of the "Stanley Johnson" defence but this was in relation to the COVID regs in the UK.Basically being part of the Johnson clan Stanley decided he wanted to go and spend as much time as he wanted in his house in Greece. His son obligingly changed the regulation to allow for a visit to prepare/repair house for rental or for Covid preparations to be put in place at the premises.

Thank you everyone for your replies, I had been told that you can apply for some sort of 1 year Visa which would give me extra time but I am unsure what this is called if it is available. I had it in my head that I would stay in Spain for less that 180 days to avoid registering for tax if this is indeed possible.
Thanks for your help.........

The NLV is initially a one year visa but a bit of a pfaff around to sell a house, plus of course it needs to be applied for in UK which can take months if indeed you can actually qualify re income etc.
If already resident that may not be a workable route anyway because you'd have to surrender it, return to UK to start the NLV process and the face inevitable questioning over such an odd move.
