Rental agreement
Hi we have had a rental agreement exposed to our Spanish lawyers and they have made changes and to which all parties have agreed.
However we are now facing difficulties with the villa and the other parties to the lease which is written under Spanish law are based let us say in the Middle East I am now of the belief that there is no likelihood of success. Imagine Spanish Courts dealing with an issue here in Spain against an jurisdiction say in the UAE Cut and run I suppose? Fred? what please are the reciprocal agreements legal wise - any thoughts? best wishes |

Is the villa in the Middle East, or just the other parties to the lease?
I would imagine that legal fees and court costs would rapidly dwarf the economic value of the lease, in other words you'll spend money needlessly and get no benefit from it. Therefore cut and run if you can do so cleanly (without risk of being sued). |

Hi the property is on one of the costas in Spain. As a lawyer I do not wish to cut and run indeed I am an old fashioned common lawyer. I have views as to obligations and all that good stuff. But if the parties are outside my striking zone? The parties are UK nationals but not and have not been resident in Spain for years.
However the issue is whether one of us gets the first blow in. One's beliefs to do the right thing? |
