Default Recidencia Card, and overstay

Hi everyone,

I'm British married to non-eu.

So i've been waiting for various appointments so i can get my recidencia card, while i'm waiting my wife's tourist visa is nearly expired and she cannot start her process for the recidencia car until mine is complete.

Will this be a problem having an expired tourist visa, is there a law protecting us ? Should we leave the country and get another 90 days ?

Anyone have a similar problem?

My wife is panicking she's going to get thrown out of Europe for being an illegal immigrant, anyone we could talk to for advice would be great.

Thanks

As regards your non EU wife, I am not sure of the situation, hopefully someone will answer that one. As regards you, being British and applying for your 'residencia' in isolation and in your own right, what has been the hold up? I don't get the various appointments bit, as provided you have the income / healthcare etc, its relatively straightforward for YOU as a current EU citizen.

As this is getting urgent, I would not mess around, employ a Gestor experienced in this asap, they can open doors that you can't. If you have a Gestor on this already, get another one that can help!!!!

...in some areas now, it can take months to simply get an appointment at the extranjeria.

Here they only issue 5 tickets per day. If the queue is long, you don't stand a chance unless you start queuing at 05:00!!!

Yeah its the cita previa thats taking so long every appointment is months away. Has anyone ever been denied a visa because they overstayed?

If my wife overstays her Schengen visa and gets denied in Spain whats our chances of moving to England?
