Questions about ¨paro¨ UNEMPLOYMENT benefits in SPAIN
Situation
- I have an indefinite contract.
- I worked about 5 years and want to leave and get paro.
Questions
1) If you have a ¨contracto indefindo and you quit you don´t have the right to the paro/ unemployement benefits. Is this correct?
2) You only get paro if you get have a temporary contract or get fired (if it´s not your fault). Is this correct?
3) Speaking of getting fired. If you get fired because of disciplinary reasons (late, bad performance), do you still get paro?
4) 5) If you have a contracto indefinido and quit and then work for 3months an a temporary contract you will get paro.
5) If you have a contracto indefinido and quit and wait for 90 days you will get paro.
Can someone verify this information for me?

If you get fired you still get the unemployment benefit. Normally the employee should dispute the firing and go to a tribunal, in Spain they tend to find in favour of the employee which means there should be an indemnization ( not as generous as it used to be ) and the employee can register for unemployment benefit.
Leaving the company voluntarily normally excludes the employee from unemployment benefits unless there are mitigating circumstances - company offers a job in another town and the employee has to move house being an example, another being non-payment of salary during a certain period.

That will probably not get you very far. Most companies have quite clear disciplinary procedures which will involve going through a series of "official warnings". They need this as it will have to be demonstrated at the labour tribunal that they have done everything correctly before they fire you. You will have to accumulate a large number of days away

So if quiting does not give me the right, I rather be fired.
The question is if you are fired for disciplinary reason, do you still have the right?
Or should I just find a temporary contract 3 months and then don't renew.

No not really. I want to pursue "travel". So I don't want to leave money on the table.

She asked me if I could fire her so she could go travelling on the proceeds on her paro. I said, no!
Some things in life are morally wrong
At a time when many people in the UK voted to leave the EU because they thought that foreigners were coming to play the benefits system, the OP should be foolish to admit on the public forum that it is their ambition to do just that in Spain
