Power of Attorney
 

Hi everyone

I'm new to this site and finding it really useful so thanks to everyone who posts here! :thumbsup:

I do have a question I hope someone can help with, I am currently working in the far east but have an off plan property nearing completion in Moraira, I don't want to have to fly back to do the signing at the notary (not enough holidays or money!!), I have read some threads about granting power of attorney and that looks a good option. Any tips on how to achieve this when not actually in the UK?? :confused:

You mean .... when you're not in Spain.

We set ours up with a solicitor originally. A visit to her office, and then a trip to the notary. You have to be here though, afaik you cant do it from afar

Hi Mitzyboy,

Not quite all the story, you can set up a POA to be used in Spain at a Spanish Consulate. We did them for our children at the Consulate in London and they advised that we could do two names on one POA which cut the costs, total for two was about €35 plus IVA. The application forms were available on the Consulate website. We filled them in sent them off and then telephoned for an appointment for the boys to go in and complete the POA. A member of the staff is a proper Spanish Notary and you are effectively in Spain when on the Consulate premises.

When I was a plumber I worked in quite a few of the embassies and that fact used to scare me. :eek:

Thats true Embassies are Spain but I think Consulates are not quite.

When I was working in Saudi Arabia, the consulate was considered 'british soil', which ment we could hold party's and functions there and alcohol was freely available as it was UK turf..

The cops used to hang about out side and they knew full well that people were a bit sozzled when they came out, but as long as you didn't cause any trouble, and were not carrying any bottles, then they looked the other way, which was jolly nice of them considering their laws on alcohol over there...

I won't say that this applies to all consulates in all countries, but I would consider it a reasonable assumption... :shrug:

If you set up the PoA through a bilingual UK notary public it can be sent for signing before a notary public in your own location.

Presumably you could also do it directly in the country in which you are currently located but finding someone who has the wherewithal to do it properly could be difficult and unless it is exactly right it will not be accepted by the Spanish notary before whom the subsequent signing of the escritura takes place.

It is a very expensive and time consuming exercise but can be done.

Many thanks for the guidance, currently in China so not so convinced they would get it right here, but have found out there is a Spanish consulate here in Shanghai so thats good, may go have a word with them to see their take on it.

I just found out though that I have to go back to the UK for work for a few days in March so hopefully I can get the POA setup there when I am there so that either my lawyer in spain can sign for me or I can send a willing friend to sign for me!!

PS. Mitzyboy, I did mean when not in the UK and not Spain, I got that i could setup a POA from the UK but being in China I wasn't so sure I could achieve it!!!!! Sorry for any confusion!

If you want to do it in London you will have to set it up before yoiu arrive and get an appointment to do the actual signing. You can get all the info on the internet and when you have filled in the form and sent it back to uk you can telephone after acouple of days for an appointment.

Thanks John & Kath, good to know, I'll look into getting the documents setup before my trip in March, as long as they don't need posted here, China post is :lol::lol::lol: unreliable! usually i have to get things couriered if they are important, which is a bit of a pain!
