Moving and renting in Spain
Hi. I am moving to Cabo Roig area of Spain next June and will be renting a property. I will not be going for residency at first.
I have spoken with several estate agents and they rent for 11months only. Does this mean if I take my belongings out there I have to move out for a month then move back. I'm new to this so am unsure. I plan to rent for at least 2 to 3 years. Any help would be great. I will have loads more questions as I get near to moving Graham |

I will have loads more questions as I get near to moving Graham If it's a legal contract, then you have the right to extend it for up to 3 years without the need for a new contract or anything. You are obliged to sign on the list of foreigners (aka 'residnecia') within 90 days (this will also get your NIE). You will then need to get your padron. As far as rental is concerned, the law is 1 months security deposit (fianza) and 1 months rent up front. Some agents/landlords will try and tell you different but be hard! It's not illegal to pay more fianza, just not necessary (and you may not get it back). |

I will have loads more questions as I get near to moving Graham My "Long term" rental contract was 11 months to start with and then extended to another year, then longer term up to 3 years and more if everyone is in agreement. No you don't have to move out for a month. As long as you keep paying what you have agreed on the contract you will be ok. Don't forget, landlords like to keep good payers as they are in the business of renting! Our 2 bedroom apartment is €500 per month plus electric, nothing else. We had to put 1 month deposit and 1 month advanced rent. Steve |

Planning to arrive in June can cause some problems because landlords may want to let through the main summer months on short term/high holiday rental rates and thus your choice will be reduced.
The other posters are correct all that 11 month stuff is total rubbish and now against the law. You need a rental contract to la Ley 4/2013 de 5 de junio. There are a lot of shall I say 'less than professional' agents in that area who either through ignorance or other motives operate outside of the law. (I used to live in that zone) But having said that I do know people who are happily renting there but they have been around a while and so are experienced. |

Thanks for your replies very useful.
Another quick question I was told I need a N I E beforeopening a bank account. I've looked on line and it states the N I E lasts 3 months then I need to apply for residency I'm a little confused as I'm not looking for residency straight away but plan to open a bank account in January Can you help Graham |

No need for an NIE to open a non residents account, just your passport and some cash and Sabadell.
You have incorrect information about the NIE. I had mine 2 years before I came to live here, they last a lifetime. If you come to live here you have to sign the foreigners register (residencia) within that time. |

Until earlier this year the certificate only lasted 3 months but that's been reversed and, like before, never needs renewing. Some banks will insist on an NIE even for a non-resident account (even Sabadell) it just depends upon your particular branch. Like @tebo53, our Sabadell branch doesn't require an NIE |

I am coming out to Spain next week and was going to do the NIE before I come out there I also read that I need a letter to confirm why I need the NIE. I am coming out there to live but not till June. Can you helo You do NOT need an address in Spain, a UK one will do fine. Unless you specifically need an NIE now, why not wait and get it when you register as resident? Alternatively, apply for it when you're here. |
