Is Malaga Airport open today and tomorrow 4th and 5th December for flying out?

The BBC is reporting the controllers are returning to work after the Government's threat of prosecution.
I would expect a gradual return to normality over the weekend.

There are flights showing arriving and departing on their webpage, so I assume so. There may well be delays, you're advised to contact your airline though.
