Just so you no Jesus Gil y Gil was a personnel friend of Franco, in 1967 he was arrested when one of his buildings collapsed and killed 57 people.

He was released on Franco`s personnel orders, he has been a outspoken member of extreme right wing groups for more than 30 yrs before founding the GIL group of like minded Francists.

The PP was the leading group in both Civil Wars, Franco financed them, and Aznar was a leader of a Francist group used to teach young Politically intelligent people who could one day run Spain, today that group still excists within the PP and Aznar has been openly supporting the old regime.

PP people are francist because its a right wing group with a membership of very extreme people.

PSOE were banned under Franco, the PP was the only group.

Never mind demolishing people's homes - how do the authorities live with themselves, allowing more and more houses to be built.

No-one seems interested in stopping the building of new properties which are illegal.........before they are sold to the suckers.

Oh sorry, of course, they are crying all the way to the bank!

Didnt actually mean that Spain would be nothing without expats,perhaps didnt phrase my post very well,(also plse see my previous posts in this thread),was merely refering to the freedom of movement enabled for EU ctizens,brought about by the EU,in response to Econs "pointless eu" post.

Okay, I think we may have done the political discussion to death, or at least to the point this thead is in danger of being moved to TIO!

So, pop quiz hotshots... do any of you highly enlightened people know the answers to the following questions...

1) If you find yourself in the situation that these people did about 18 months ago when the very first letter from the Town Hall arrived saying something like "now, about that planning permission you thought we'd given you..." - what the hell do you do next? Sit and wait for the inevitable?

2) We all know people that could be affected by this. Every situation is different - in this case it would appear that planning permission was granted, albeit in the usual Spanish way ("You want planning permission? Sure, we'll give you planning permission, just fill in this paperwork and that empty carrier bag in the corner of the room"). So, what compensation (if any) should one / could one realistically expect, how long is that likely to take (i.e. if you're in your 60's will you see it in your lifetime), who precisely is going to be paying said compensation and who (apart from your friendly abogado) should you take your claim up with?

Please keep your answers practical and sensible. Sadly, this thread may come true for a lot of other people in the future...

In this particular case, the couple got planning permission from the Vera Town Hall. The Junta then rescinded the plan saying that building there would cause a nucleus of homes in that area. The town hall said that was not the case (four years later, there are a few houses on minimum 10,000m plots but it's mainly scrub). The house was built and the water company and Electric company were satisfied with the paperwork.
The Junta problem apparently rumbled on - but the order of 'desalojo' was sent two weeks ago, while the case was still in litigation.
Vera town is governed by the Partido Andalucista and they, naturally, claim that the Junta, PSOE, is victimising them rather than PSOE-led towns in Almeria.
The odd thing of it is that this is a pretty quiet area (it's behind Vera, near an institute for the handicapped). In Almeria, the PSOE press say 'it needs to be done' and the free press talks about 'victimisation'.
However - despite whatever laws, rules or inclinations that there might be, could the Junta ever knock down all the illegal homes in Andalucía? I mean, really?

Of course not. But they can knock a couple of high profile ones down, make the headlines, and prove that they are big and clever. Isn't that what this is about at the end of the day - political point scoring? "We're in the majority, you're overruled..."

Apparently the problem is not the law itself,but a loophole in the law which allows unscrupelous developers to seize a proportion of land for urbanization,OR,demand a 10% of the land or properties value to pay for "infrastructure" in said development (presumbly for utilities to go around land or prop targeted)
So far no claim for compensation has succeded in the Spanish courts (no reason given by source).
It would appear that the only way to avoid loss of property under this "loophole" is to pay the 10% demanded
However there is potential good news on the horizon as a group of lawyers have come together (Spanish & British),to challenge this situation under Section1,of,Protocol1,of the European Charter of Human Rights,which garantee's the right to property,they are still collecting case's to add weight to their caseThe case is being put to the European Court at persent with a lead time approx 2yrs to be heard,obviously if it goes against the developers they will appeal,so will go on for sometime yet

Spain has derived many goodies from the EU... but watch how it will pay for those goodies in the future as pay back clicks in... just as the UK has and is now... and this is only the start. A lot of this is why people from the UK came here, it's better and cheaper for them, but Spain is now only just a few steps behind... it used to be miles away.

Re Illegal properties:Poss talking about 2 different situations here so decided to post this;With to the regard to the unfortunate couple in the situation posted by OP.
Knocking down of illegal properties CAN be challenged by a position known as
"Public Faith In The Registry",what this means is; If a property is purchased in good faith,ie believing the details held on the local registry,then,they should be able to keep it.
Further,Spanish mortgage law also protects owners under the same principle
It also means that a building can only be knocked down if ALL the owners were denounced,and it could be proven that they ALL knew that the license was null (illegal).
Legal challenges can be mounted under these clauses,if successfull,both Town Hall,and,developers can face massive fines
To lend credence to this,it has come out that a former Prime Minister of Spain,unwittingly,bought illegal property,and used this clause to mount a successfull defence.

Do's this consolidate my position as "Pop Quiz Hotshot"
