Okay, in the absence of any further info on co payments etc. I can only say, if in doubt visit the relevant office in the area you want to settle in and ask. It's good that anyone applying for Residencia asks for up to date info shortly before taking the plunge.

​​​​​​​​​​​​What Lurchio says re co payments is certainly correct for applying for residency at Torre Del Mar, they will not accept any co payments and the policy must be fully paid up for 12 months with a certificate from the insurer basically stating you are full covered to same level as the public health system. Yes one can get the Convention Esoecial but only if you can prove you have been resident and on the Paxton for 12 months.

Just to say that we have had our Convenio Especial payments made on 2nd. August refunded to us. As have two of our friends. We live in Andalucia.

I have posted about this separately to see if others are in the same position!

All under 65 legally resident Uk ex pats in Andalucia that were previously on the Convenio Especial public health cover and paying 60 euros a month have had this month's payment refunded and a press release states it will not be charged for going forward..... I have received confirmation that the new law does not change the requirement to prove full health care cover when applying for residencia, you still need either S1 or full private health care cover.

So possibly a bit of a catch 22 situation, required to make and complete application but once resident you could cancel private and apply for healthcare under new system?

Cheers, as you say how NEW applicants for residency are affected by this new decree is basically as it is now until such time as we are told different or a NEW applicant posts with his or her experience one way or another.

Honestly, the best idea . I will be the 'guinea pig' for the Convenio as already resident, now we need someone who wants to apply for residency! Bob, I know what you said, but the pinch point is that there is no transferable cover. Once you tell the UK you are seeking residency here, you are cast adrift from the UK NHS and then similar in a way to the poor sods this law is intended to help. So what's the difference? (No S1 / OAP age obviously, just the Legislation letter)

Ian technically you are correct however as I still have the private healthccover in place from last time I did this it makes no difference to me. Also do you obtain residency before cutting yourself adrift from UK? If you don't then you are technically covered by EHIC untill resident? If you cut yourself adrift without benefit of an S1 or private health cover it is a risk in my view as you have then lost right to EHIC? Trying to argue the point at the foreigners office with a Spanish official who says you must prove health cover will be a pointless excercise in my view. I will get the residency and then look into cancelling my private health care? I simply see it as a catch 22.

You cannot get free healthcare without residency and you cannot get residency without healthcare - unless you are a paperless refugee!

Of course there is the slimmest possibility that common sense will prevail and they will realise that this situation is costing everyone involved time and money. We can live in hope.
