There have been five more “unlawful incursions” into British Gibraltar Territorial Waters since last Sunday a Convent spokesperson confirmed yesterday. In answer to Chronicle questions the spokesperson confirmed this had been the case since the incursions at Sandy Bay involving a Spanish customs boat and SVA helicopter.

Spain has denied there was an incident and “let alone an illegal incursion” last Sunday in BGTW. Spanish Minister for Europe Fernando Eguidazu, in a formal response yesterday to the written protest on Wednesday this week by Minister for Europe David Lidington on the incursions into BGTW by a Spanish Customs boat and SVA helicopter on Sunday 9th, reiterated in a letter there had been no such incursion because he insisted “the waters are Spanish.”

A vessel can only be considered to be on innocent passage through British Gibraltar Territorial Waters if it's moving continuously and expeditiously, and is not engaged in any activities that are prejudicial to Gibraltar or the UK. That's the basis of expert legal advice received by the Government on the question of innocent passage as it relates to the United Nations Convention on the Law of the Sea.

Spain’s Foreign Minister, José Manuel García-Margallo, signalled continued pressure on Gibraltar yesterday, repeating an earlier warning that “the party is over” for the Rock while insisting that Madrid was nonetheless committed to dialogue.
Speaking on the Espejo Público programme on Antena 3, Sr García-Margallo repeated words he first used in August 2013 when he confirmed a multi-pronged campaign targeting Gibraltar.

Fishing for Blue Fin tuna is illegal in British waters.
The United Kingdom does not have a quota for this species.
Therefore if Gib has authorised catching this species clearly it does not regard its waters as British and is not part of the UK.
