Flying Freehold in Spain
 
I am wondering if anyone has experience of purchasing a property with Flying Freehold in Spain ?

As far as I know that is a peculiar to England and there is no equivalent in spain?

I don't think they have a "flying freehold" as such but a friend who bought a small terrace property and during the refurb of the kitchen floor they broke through into a cellar they did not know about. It turned out it was not a cellar to their property but a store for a fish procesing plant on a lower level behind. Flying freehold says I, explained what that meant in England (say a bedroom over an entry in the middle of a victorian terrace). In Spain you have independant freeholds but they may happen to be entered at different levels from different streets.

Flying freehold is alive and well here in Spain, that I know for sure. Thanks for your replies.

That's interesting because when I posted about this (on this site) some time ago, I was assured that it didn't exist in Spain.


I have a property that has a 'room' under the next door's building. My deeds tell me it's mine but there is no mention of a 'flying freehold'.


I shall watch this post with interest.

By my understanding of it you are not the one with the Flying Freehold, the party who own the part above you do. I would have thought there needs to be something in your deeds telling you this, as you are not free to do anything that might effect their building.



snikpoh, where did you post about it ? as I have tried searching with your name and 'Flying Freehold' and came up with only this thread.

I posted this one Freehold vs leasehold which led to a conversation about flying freehold. But, like you, I can't find the flying freehold one. I might have done it on another forum (hush my mouth:ohmy:).

Your right about the other party holding the flying freehold (I actually have no idea as the property is derelict) but I would have thought that my deeds would have mentioned the issue.

Part of my house sits over someone elses property. (Ithink it the store of the farmacia next door) There is no mention in my deeds referring to this and my lawyer never raised it with me at the time of purchase. It doesn't worry me as its been like that since 1887.
