Hi !

An associate of mine has a UK registered car in Spain. He is claiming that the car is legal as it is insured in Gibraltar and has a Spanish ITV. Can this be true ?

Any comments would be appreciated.

The Spanish ITV is a courtesy only if you are on UK plates, we made the same mistake some time ago but now drive on Spanish plates.

Short answer is 'maybe'. If your associate is driving in Spain for up to 6 months, then returning to the UK and is up to date with the MOT (assuming it is over 3 years old) and has a UK vehicle licence, then I believe the insurance would pay in the event of an accident.
I would not like to risk being involved in any accident if the vehicle was in Spain 'long term' . The Spanish ITV is not acceptable for a UK registered vehicle. Unfortunately the MOT test applies to all UK registered vehicles. Maybe one day there will be an EEC unified test !

Similarly, if a Spaniard went to UK with his vehicle and was staying 'permanently' the vehicle MUST be registered and licenced as soon as possible after it arrives in UK. The Spaniard should not expect to be able to drive around in his Spanish registered vehicle and would certainly not be able to get any UK MOT test on Spanish plates !

There are insurers in UK , in Gib and in Spain who like the colour of your money but who may not be so willing to part with it in the event of a claim.
