Driving illegal car
Like I mentioned on the RHD car thread we are borrowng a very dodgy van type thing while our car is being repaired (yet again).
If it is illegal can someone please tell me who would get in trouble if we were stopped - us, him or both of us.

I would have thought the person driving the vehicle is responsible for the legality of the vehicle.

We have asked him about our concerns and he says that the car is in the process of being matriculated onto spanish plates.
Dosent make sense to me and the guardia seem to love hanging around at the entrance to our estate.
We have already been stopped in our own car. At least our car is legal but he let us pass as his son is in my daughters class at school.

Quite simply, it is illegal for a Spanish resident to drive a foreign plated vehicle.

I suspect that the trouble is, if you are stopped then the 'van' may be impounded - so you'd both be in the brown stuff!

The owner of the vehicle os responsible for the road worthiness of the car, along with ITV, etc.
The driver is responsible for the occupants wearing seat belts, drink driving, etc.
In reality, should you be stopped, I suspect that you would be fined for some spurious reason, and the owner would get some nasties in the post.

I have a similar and was told it is classed as a furgoneta (van) and all that goes with that i.e. different regs to ITV etc

I don't really want to open all this up again but some STILL say that disability vehicles do NOT have to be matriculated and that one can easily have them replaced (every 2 or 3 years) with the full knowledge of the peeps in the UK!
