Does a UK will cover property in Spain ?
 
I'm sure one of you helpful people will know the answer to this ?

We recently drew up our Spanish wills having been told our U.K. is not valid here. Easy to do

The UK will does not cover property in Spain. We had a "Spanish" will drawn up not long ago, which I think cost us around €50 with a notario.
It didn't take very long & only 1 visit!!
Bear in mind that here inheritance laws are different to UK.

I am English, my wife Spanish. If she dies 1st, then I am "allowed" as of right to live in the house as long as I live. Once I'm dead it goes to our 3 children.

A UK will does cover property in Spain!

It is advisable to have separate wills for each country only for ease of probate but it is not strictly necessary.

Basically it is much easier to sort out a Spanish will for Spanish property than it is to do it using a UK will.

That is not necessarily true.

If you are English (even if you are a Spanish resident) then you can leave your property exactly as you wish (so long as it conforms to English law) - Spanish succession law does not apply. Also it doesn't require a Spanish will to achieve that although as I said in the other post it is advisable.

Your situation is different as you are married to a Spaniard. My guess is that you can leave to whoever you like but she can't.

Thanks all. So really to be on the safe side it's best to have a Spamish will to ease complications, although hopefully when "the time" comes the recession will be over and we will have sold our house in Spain :thumbsup:

Thanks for that. Altho' I'm an "ex pat", obviously my wife isn't, so I tend to go along with what I'm told!!!!!

If the property you live in was inherited by your wife, then that is the case, it will pass to your children, and you have the right to livbe ther-



But if then property was bought by both of you then your half will always be yours.

I think here he means a Usufruct which is not possible in UK but can be used in most continental EU countries.
