Hi everybody,

Another question regarding my efforts to get back to Spain.
I am pleased to report that my letter arrived today.

If you are unfortunate enough or stupid enough lose your green residency cert, you have to go to the police station and file a report, denuncia

I now have in my possession, a copy of my green cert.. and I know they won't look at a copy
but I also have a denuncia.

Is a denuncia valid in any situation where you're supposed to provide official documents?

Like airport security check in the face of the current ban for example.

Earlier you said "My neighbour went into my flat and has sent it by post." referring to your residencia but now you say you only have a copy.

Best not to go into how you obtained a denuncia but whether it will work or not who knows.

Even with a residencia or TIE though you're likely to find it extremely difficult to find a flight to Spain, looking at Alicante arrivals for instance they are precious few and demand must be very high.

You need an autorización de regreso (apply using modelo EX-13). See here for more info in Spanish.

I'm not sure how this works outside of Spain. Maybe you can do this at the Spanish embassy, it might be possible to start the process of applying for a new replacement TIE at the embassy at the same time too.

Thanks, that seems to be something that you should get before you leave Spain if your id is going to expire while you're away,
or if you leave while still in process of applying, but anyway, it's certainly interesting and if I can get me one, I shall wave it in their faces at their airport.

​​​​​​No . It is however often accepted in most situations with either a photocopy of the original produced or the document number.

No you don't. Ex-13 is irrelevant.

Apart from some extremely limited exceptions to currently be admitted into Spain via air or sea requires you to be Spanish or have legal residence in Spain.

The Spanish have stated to show legal residence holding an old green paper EU residence certificate or the new TIE will suffice.

The FCDO currently state it is unclear what else they will accept.

​​​​​They clearly should accept a padron as it " proves " currentish residence more than the " old green paper EU residence certificate" does.

My advice would be to obtain a report from the UK police for the loss of of Spanish documents listing them in Spanish along with thier numbers and including the Spanish address before flying ( I can provide an example via PM )

Alternatively it is still possible to fly into Portugal and cross overland.

He has residency, he just can´t prove it using a green certificate/card or a TIE. In that case, he needs an autorización de regreso which is applied for with an EX-13.

They won't accept anything else - padrón, property deeds, electricity bills, whatever else the British government likes to dream up to get people off their back, Spain will not accept them. Ignore the British government.

He already has one, but that's not good enough for entering Spain.

Portugal will only allow entry from non-EU/EEA nationals who can prove residency in Portugal or another EU country, so we're back to square one unless you want to try and bluff your way through two airports with a copy of the green certificate/card or you can prove your reason for travel is "essential purposes, such as to live with immediate family members, or for professional, educational, health or humanitarian reasons".

I dont understand the original OP?. I thought they said that they had not brought their green residency card with them when the initially travelled to UK. They then found that to return to Spain they would need to show it. They said a neighbour was posting it to UK. Now they say they have a copy of the card and have made a denunciation. How can they have made a denuncia if they are in UK? It all seems a bit strange. Surely if your home is officially in Spain you have a right to return but you have to prove your residency. Has the OP actually contacted the Spanish consulate ? If not why? It should be easier to find out the situation by talknig with officials than using a forum, no?

When I referred to my green certif in my first thread, I didn't mention that I was talking about a copy.
My purpose in posting was to sound off about why they can't identify me using my NIE.
numero de IDENTIFICACION extranjeros.

I was fairly confident that my denuncia would be ok, after all it is an official doc from the police that says I used to have a green cert but it is lost. It has all the same info. In fact, when entering the details into his computer the policeman who made it was looking AT THE COPY.


The Spanish Consulate is closed until further notice because.... well, take a guess.

So you appear to be saying you lost your original card before going to uk and had already made a denuncia whilst in Spain. However, you did have a copy of the card. But why didnt you before leaving apply for another card? If you made the denuncia you would have been told to get a replacement. Now you have the problem that you have a copy which wo t be accepted and a denucia telling you that you should have replaced it. Have you tried talking to the guardia civil office where you made the denunciation they will have an official record of it and be able to check your details? It really shouldn't be difficult to establish your residency in a police station

I was in the process of trying to get the new TIE card but on two occasions they sent me away because I didn't have the right paperwork. My next appointment was sheduled for 4th Jan by which time I should have been back in Spain for a week.

I didn't bring the green certif or resguardo de solicitar TIE with me when I left Spain because on the 18th Dec nobody was talking about new variant of the virus and nobody knew that Spain would ban uk people. And I was supposed to fly back to Spain on the 27th. Before any Brexit complications come into play.

That's like saying you should take your passport when you visit Wales.

Now, you say I should speak to the police where I got the denuncia and they will give me, what ? A document that says I had a green certificate but I lost it. That's exactly what a denuncia is, and I've got that.
There is nothing on the denuncia, by the way, which says I should get a new green certif. It is simply a record of the same details and says the original is lost.

But why don't you phone the guardia, explain your situation and see what they advise you to do? Wont that be an easier way of finding a solution than trying to guess what will happen or how everything is processed?

You say you had 2 appointments and was turned away as you didn't have the correct documents. If you have residency already there shouldn't be any documents required. I thought you just completed application then were given an appointment where your fingerprints were taken?. You would only require different documents if it were a first time application. Or am I wrong?

The first time I went they asked to see my green certif and I said, here it is, but this is a copy and they said, copy no good.
so I went to the police station to make the denuncia. Went back again and the policeman said, you need a certificate which says you are resident in Spain. So I said, what's that you've got in your hand? But no. Another form to fill in EX something and another appointment with different office, scheduled for 4th Jan.

I realise I have made a big mess of all of this. My life would be so much easier if I didn't fly back to uk to see my folks at christmas, but filial responsibilty dictates that I must. I thank you all for your assistance.
