Could we live in Spain easily???
 
This is just my second post so just to say hi!

I wouls be so grateful for any advice anyone could give us on the following...:)

I am a British national and my fiancee (soon to be husband) is Argentinian

We don't fancy living in either the UK or Argentina when we get married so we are researching all other places we would like to/could live.

My fiancees anscestors were Spanish and we were wondering if it is possible for him to apply for a Spanish passport based on this?...If so how easy is the process and does it mean we could then both live in Spain/Europe without all the hassle?

Yes it is very possible for him to apply for a Spanish passport:)All individuals who have at least one parent of Spanish or LatAm origon can apply for Spanish Citizenship after 2 years legal residency:)
The requirements are as follows;

At least one parent MUST be of either Spanish or LatAm origon.
Must present his/her birth certificate.
Must present his/her parents birth certificate.
Fluency in Spanish (presumably no problem)
Proof of two years legal residency.

I have quite a few Argie friends who live in Spain working with the polo scene, if you want I can ask them how they did it.


A very good friend of mine is also married to an Argie, and I know they have a few problems every year with the visa, and he lives here 11 months of the year.

It's very good news that he would be able to apply for a Spanish passport

Just a couple more questions if I could please :o


1) It was his great grandparents who were the ones to move from Spain to Argentina so both his PARENTS are Argentine born....does this affect things?

2) Does he need to be living in Spain for 2 years before he applied for the passport and if so how would we go about living in Spain for those 2 years...ie, does he need a Visa etc?

EU citizens can live without restrictions in any EU country. Does not the same apply to their husbands/wifes even if they are not EU citizens?

No need to apologise,if you dont ask you will never know:)

1) Grandparents situation is fine the heritage is still there:)

2)Yes he would have to live in Spain legally for two years,its a condition of Citizenship.

If you are getting married I would assume he is a UK resident?,if so I dont believe he will require a visa for Spain,but prob best to check:)

I find that confusing too. My (Spanish) friend is married to a Turkish man and they have lived in England forever. She keeps going to the Spanish embassy in London to get a visa for him every time they want to go back to Spain and visit family.. the same applies for any other EU country. Some years ago they were planning on going to Ireland and had their plane tickets booked and his visa got denied :blink:. I don't know if being South American your life is easier cause it appears that if you are from Turkey you are not welcome anywhere :(

If your fiancé has had Spanish ancestros (like parents, grandparents, etc) I believe that he has right to the nationality, at least the direct descendants. You can inform yourself better in the spanish embassy or some consulate of Spain in United Kingdom

The Spanish/LatAm heritage thing in this context purely applies to Citizenship
criteria,it also applies to Phillipinos,Sapphid Jews,and some others including,I believe Andorrans.
It appears to be people from the former empire who qaulify,presumably for cultural and language reasons.
Pretty sure on reflection that residents (as oppossed to citizens),who are married to a citizen of that country have the right of residence in another country,if not the visa process is prob pretty staightforward:):)

Further to this,I have just checked on the EU website,and the news is good,your husband CAN live with you in Spain.

This is what it says,(paraphrasing),the spouses or family members who are not citizens of an EU country,can accompany the EU citizen, freely,with the same rights as that EU citizen.

For exact text go to europa.eu,if this doesnt take you straight to it,type in "free movement in the eu",and it will be the 3rd or 4th entry down:)
