I think there is a form to fill in and submit to the government.

Where to get the form - don't know

What then - don't know

How long - don't know

I think they are supposed to cross check the health record and your income tax return. If you haven't done a tax return they won't apply the €8 cap.

So your drugs cost €700 a month?

It may be that you have to claim it back via your tax declaration. That's the way it used to be some time ago and only they know whether you are entitled to the €8 cap or the €18 cap.

Yep I'm single handedly trying to bring down the Spanish health service;)
My prescription list from the doctors list me as a 10%er and as usual I was told by the Hacienda I had no need to do a declaration as my pension is UK taxed.

if you've been submitting tax returns it will be on record that you shouldn't be paying more

unless you are seriously loaded!!

They just say that to get rid of you. Even if your pension is a UK government pension you need to submit a tax declaration to be able to prove that you are tax resident even if no tax is due.

So, basically you will just have to pay the full 10% with no rebate.

This is a common misconception which this forum has tried to help overcome.

There are so many reasons to do a tax return in Spain even if it ends up that no tax needs to be paid!

What happens when you 'pop your clogs? As a non-resident, you stand to lose an awful lot!

I'll need to take out a mortgage or die then:D Can I go to the Hacienda and demand to fill in a return?Although I still can't get an answer as to who makes the repayment and how and when as experienced by an earlier poster

That's exactly what we did. Went to the local hacienda asked for form MODELO 030 to register as a tax resident. filled that in and submitted at the front desk. Asked Nottingham for our FD9 forms and took them together with our first tax returns filled in via PADRE and Bobs your uncle we were in the system.

Of course it did not go that smoothly it took nearly 13 months and they looked at us daft wanting to fill in and file zero returns but that is just what we do and we are on our fourth year now so a couple of years and our 5 yrs will be in and we will be able to claim all the reliefs we are entitled to on the first "event".

After a two hour trek around Gandia the answer is a step nearer. After visiting the Hacienda,Seems it's nothing to do with the Hacienda but is dealt with by Commisario de Sanidad in Valencia in C/Mincer Masco 31-33 Prop in Republica Argentina in Gandia printed me the Solicitud and the Modelo Bancaria They pay the overcharge back into your bank every three months..........allegedly ;)
