Can we really claim capital gains rebait
I was browsing the internet and came across a site that claims that there has been a new ruling throughout the EU saying that if i sold my property between 2004 and 2007 in spain and paid the 35% capital gains tax (which i did) i would be eligible to a substantial rebait. Has any one ever heard about this or the site cgrefund.com? I would be grateful for any input. Thanks

Have a look on the Free Beer Thread under Spanish Tax. It does say it was equalised under EU regs

If you are British, even if you were successful in claiming back any tax from the Spanish authorities (which I doubt), you would have to hand it straight over to HMRC as the CGT rate was 40% in the UK at that time and you are liable to pay the difference. You should have paid the 5% difference the time anyway so claiming would prabably get you into more trouble than it is worth which is precisely nothing!

There was a thread on this before, the link was to a company advert claiming they could get it back for you....... at a cost.
