It is a step by step guide on what you have to do to set up in business. I have posted the link for "autonomos", but you can also click on the steps for Sociedad limitada or whatever it is you are planning on doing.

You could set up an SC company with another person who has a NIE, I have mine with my wife. This is a low cost way to go and I run a couple of types of bussiness under the same company but have each listed in the SC Company contract "Contrato de Sociada Fiscal" and so permits my company to be involved in the types of bussiness I have listed in this contact. You can add to this list at a later date but I suggest you think of any business you or your wife might want to be involved in and list it there, it doesn't cost any more except if you actully do decide to do that type of work and apply for your fiscal licence for that category. BTW check the categories that the work you want to do is listed under, you can do this in the hacienda.

If you can converse well in Spanish then you could do all this yourself but to be honest it is simpler just to give it to a Gestor or Economist, you will also need an NIE number from the Policia Nacional. Check around a couple of differen't ones as what they will charge can differ quite a bit, it you use the people who will do your tax returns then it may even work out cheaper.

BTW, if you are a painter you do not need to list a business local as was the case years ago. I run my couple of businesses from my apartment address perfectly legally and one is a maintance and painting business "run under the same Sociadad Civil as my other two types of work". You could also find a lockup and store your tools there just as many of the Spanish do, that's if you didn't want an offical local or taller.

It´s all fresh in my mind cos a relative of my other half collects the free DVDs that the Daily Mail give out every Sunday and sends them across to us in Spain in job lots. They were recently giving away Darling Buds of May.

I have just literally completed on this process for Premises for our Business,
Our track went thus
We both had autonomo, set up through our account, which effectively was selfemployed. this was basically submit receipts and payments to the accountant monthly, he looked after all the taxes, we also pay Social every month 238.49€ each by direct debit,
We then decided to go S.L. again we used our assesoria, who then used the Gestor in his office,
We had to do the following
set up a notarised partnership agreement
Setup and apply for registration on the company register Madrid, in which we declared our business type etc
We then filled in various forms and models as they are called in spain, for Hacienda, and IVA.
we had to take out Liability and company insurance to complete on the above,
This all cost 650€.
A year on we have now opened up a showroom,/Shop and workshops, this we did through an estate agent (the assesoria basically wasnt interested in this)
Again huge amount of paperwork and days of understanding which boiled down to,
Application to Town hall to use premises for trading, this need various certificates including Model 036, and articles of company stating type of trade
Application to town hall (after a visit by techo, and architech to draw up plans) to obtain menos obras for build of office and workshops and change front,
This all has cost about 600€ so far,
we as yet have no permissions as these will take about two years, but the norm here is apparently once you have paid the tax on the application you can go ahead with trading and works.
Biggest problem has been changing over Social security payments, as this cant be done by just changing direct debits from bank a to bank b, you have to go in person to the local office and reapply, ( oh and if you miss a payment there is a small fine!)
My advice, give it all to a professional Gestor, Visit him almost daily to geee im along, ( otherwise it just goes in the manana pile!!) and it then goes almost smoothly..
All from the time we took the decision to trade in town and found premises it has taken about 6 weeks!!! (excluding the wait for the final licences, but everybody including the town hall keep saying dont worry!!!).

I realise no-one on here is qualified as a gestor, but after the last post, which was very informative, I would be grateful if there is anyone out there who is in a similarISH position. We are going to use the separate front room in our house as a salon. At the moment you come in through the front door and then go into it. (1) Is it ok or do we need to have a separate entrance(not uk rules, please.)

If that room is solely for the purposes of running the business are the licenses etc likely to be very similar to the previous post.

(2) In order to keep costs down, is it cheaper to register each of us as autonomo or do we go partnership, or do we register it in just Wendy's name (or mine) and go as proprietor and employed person. And what would the differences in benefits be re pensions etc.

(3) Is it better (or even possible) to continue paying self employed stamp in UK either as well as or instead of Spanish social security. Is it even legal not to pay into the Spanish system if we are resident.

We want to do everything above board - mainly because we are the ones who would ALWAYS be found out, then we would ALWAYS be the ones to be made an example of. Life is just so much more simple when you don't have to remember what you told someone. Truth is so much easier.

I hope someone has been through these circumstances before and can give us a "definitive" answer.

Just remember, do not do anything that involves a lot of time or any money until you visit a gestor to get proper answers to these questions, regulations in Spain change ... a lot and often ... what was the general rule 6 months ago may not be now, in fact I would even visit several gestors with the same list of questions before selecting one to do your work for you, and when you do you will probaby find you will need to sit on them to the stage of becoming a pain or things will get done very slowly.
