You don't understand, I am specifically talking about benefits... their pensions are a separate issue, and I think you are confusing the two issues. We pay our taxes for a multitude of reasons, and at no time did the gov think that people would go to Spain to spend those benefits. They are to benefit people in times of trouble here in the Uk and that is my problem with this... no one made them go and live in Spain, no one forced them to board the plane, more their lives to the sun... no one took them to the airport at gunpoint.... it was their choice and the second they made that choice they should forfeit their right to benefits.
The Uk has some difficult times ahead of it and lots of people are set to lose their jobs, its inevitable if we have to cut gov costs and to think thaat all the while people are being paid to sun their arses in Spain will grate the British public.

Living in Spain is a dream for many working Brits, so I can understand the frustration at the way things appear.

If everythin is hunky dory and the DWP and the UK gov have no problem with claiming benefts while abroad, what is this thread all about?
Obviously the British government cannot be all that happy with the situation bacause as you say citizens are being denied their "rightful benefits whilst living in Spain.
As far as I know they have not stopped paying pensioners their pensions.

I am sure that this was the intention when these benefits were put in place, travelling was only for the rich and certainly nobody thought that people would live in Sapin unless they financed their lifestlye out of their own pocket so to speak.
Living in Spain is a dream for many working Brits, so I can understand the frustration at the way things appear.

MINE IS TOTALLY A DIFFERENT CASE FROM THE ABOVE AS, LIKE I HAVE SAID MANY TIMES BEFORE, AS I EXPORTED MY INCAPACITY BENEFIT TO SPAIN, THIS MEANS THAT I CAN NOT WORK AND ALSO MEANS THAT THE UK ARE STILL MY COMPENTANT STATE AND ARE THUS RESPONSIBLE FOR MY HEALTH, ANY REGULAR MEDICATION I GET IN SPAIN IS PAID FOR BY THE UK, IT´S NOT MY FAULT, THOSE ARE THE RULES

You normally qualify for Child Benefit if you have children under 16 (or under 20 and in certain types of education or training) and you live in the UK.
If you live or work abroad, you may still qualify for UK Child Benefit, or you might get the child allowance of the country where you live or work.
It is not dependant on NI contributions, it is paid through direct taxation

Your quite right, pensions are exportable, as are some other benefits. The whole question was that if you were in receipt of DLA in UK then moved to Spain etc you are now able to export it and do not have to reside in the UK for 26/52 weeks. But for new claims applied after moving to Spain the DWP are still insisting that NEW claims for DLA applied for from Spain have to satisfy the 26/52 week rule. So that is what the new Regulation that is being put into place means. If I moved back to UK for 6 months, (and many have, stayed for 6 months and exported it back to Spain), I could do the same (which I would be entitled to with no problem) then move back to Spain, there would be no problem. But this is not practical in my circumstance as my children are in full time education in Spain. And I would not want to disturb their education.
You dont want to meet the criteria due to personal circumstances.....
ie disrupting your childrens eductaion.

Yes, spot on. Thats what I was trying to explain with regards to the Regulation that the DWP and Goverment are ignoring. Which sets out that you should be able to apply for DLA from Spain and not have to be in the UK for the 26/52 week rule. This is the Regulation and ruling of Judge John Mesher from the EEU and which the UK goverment must abide by as no country that is in the EEU can overrule the European Economic Union rulings.

One woman has been away for nearly 8 years, during which time she has seen her kids about 3 times.
There are folks in Spain whose husbands still commute to the UK to be able to live here.
You could look at it that it is not such a great sacrifice to be away 6 months alone in the UK, if you were really desperate.........
Obviously the benefit you are getting is enough for you to be able to live, and not so badly, if you admit it.
Only you can decide which is more important, the extra payment, ie go back to UK, meet the criteria, or just wait and see, and hope that the new PM thinks the issue is important enough to sort it ASAP.
You say the Gov cannot ignore a EU ruling but they are:
If it has been ignored for 3 years, with the cuts it could extend to decades.
I have noticed that you seem obsessed with this matter, most of your post are about benefits, and it does seem to be your "passion".
Why not accept things the way they are instead of getting all riled about it, look at what you are getting and not to what you are not. Enjoy Spain, there are lots of people in the UK who would love to be here and cannot.

I know a lot of women who are working in bars and restaurants in Spain, that have left their children with family to look after S Am countires, Dom Rep etc. so that they could come to Spain and send money home so that their children can have an education.
One woman has been away for nearly 8 years, during which time she has seen her kids about 3 times.

You could look at it that it is not such a great sacrifice to be away 6 months alone in the UK, if you were really desperate.........
Obviously the benefit you are getting is enough for you to be able to live, and not so badly, if you admit it.
Only you can decide which is more important, the extra payment, ie go back to UK, meet the criteria, or just wait and see, and hope that the new PM thinks the issue is important enough to sort it ASAP.

So there you are everyone has a different story to tell. I applied for DLA from Spain because I was allowed to, but have wait, as you say, for the Ruleing to be changed, not just for me but for everyone in a similar situation.

Wise words. But unfortunately due to my disability I can not go to UK or any other country for that matter. If you really want to know I have suffered from Extreme Anxiety Disorder/Clinical Depression/Panic Disorder and Bipolar II for the last 20 years. I have lived in Spain since 2006. My ex husband moved to Spain in 2002 with my two children, I was not well enough to go. So 4 years down the line, it was decided that I could move to Spain to be with my children with the help from my carer. I have to take Benzodiazipines (Xanax), this is a tranquilizer that hospitals use before operations to calm people, anti-depressents and Bipolar Medication. I have to pay privately to see a psychiatrist here in Marbella and also pay private for my normal day to day problems. I have Sanitas and my private doctor speaks english and is very understanding. I get my prescriptions from the local GP, who is totally uncaring, but I do not have to pay for my medication from the local GP.
So there you are everyone has a different story to tell. I applied for DLA from Spain because I was allowed to, but have wait, as you say, for the Ruleing to be changed, not just for me but for everyone in a similar situation.

How many suffering the same complaints in the UK would love to be able to say that.
You seem to have adequate income, after all you have internet, which a lot of working Spanish cannot afford.
So forget it all the delving into the ins and outs of the benefits system, go with the flow, change your name from Crustycrab (sounds a bit Victor Meldrew) and enjoy the sun, your children and Sapin in general.

Also I do get obsessed with thing, which happens to be benefits at the moment, I guess it´s because it´s been going on since 2008 and I just want it to be either officially rejected or accepted. My claim is with the Decision Maker still and I am waiting for a copy of the DWP´s submission papers and a date for a tribunal hearing. I have prepared my appeal with the help from my legal advisor. When the hearing is over and the Judge gives his verdict then I can let it drop. It´s just my personality and my Bipolar that makes me the way I am.

This is where I found the information. I think the link you have looked at is where, like I said, for example, parents from Poland can come to UK and claim CB, they do not have to have paid into the System, thats what all the outcry is about. This is because Poland´s CB is a pittance compared to UK

You get Child Benefit for each child you are responsible for. Usually, you and your child have to be living in the UK to claim Child Benefit. If you do not live in the UK, you leave the UK for more than a few weeks, or your child is not living in the UK, the rules are complicated.
