How would you answer your own question?
Usually people put their own opinion about their posts, you have given us some facts as to why it is wrong to be denied this payment, but have not given us your answer yet.
Most people on the forum dont know much about these things, for most it is just another tale of "let downs" by the government, like people being refused cancer drugs on the NHS.
The fact that the UK is ignoring the EU law, and as you say cannot continue, but it has continued for 3 years, so what doe you think GB or DC plans are on this matter?

The Regulation below is current and ongoing. This applies to UK citizens who have moved from UK to EU i.e Spain to be able to apply for DLA etc after they have moved to another EU country. It was passed by Judge John Mesher who acts on behalf of the Upper Tribunal of the EEU. This was passed in October 2007. So, as UK have been hiding behind a bush for 3 years and have not abided by the EU law, this is why it is ongoing. But the UK have now run out of time to comply and will be brought to Justice by the EEU.

There are many other Articles and Regulations with regards to my original post, but I cannot mention them all.

What RM is saying is that all these benefits come out of money collected in through taxes.
When it say that these benefits are not based on NI contributions or Tax, it means that the "receiver" of said benefits does not have to have paid tax or NI to "receive" the benefit in question.
But ALL benefits are paid out of money "donated" by the Taxpayer, that is why taxes are collected, to pay for benefits, health service, education etc.
Where do you think that the money comes from to pay the benefits out.

You asked for our opinion as to what Brown or Cam would do about benefits, what do you think the PM will do?
We have said that as it will be low on their priorites, not much will be done in the very near future.

If that were the case, the childless couples would not have to pay any taxes towards education or child benefit (which they do).
So when we lived in the UK our childrens education was also paid for by childless friends of ours.
It is not a question of "I put so much in so I sould get so much out".
I have never been in hospital in my life, hardly been to the doctor, so even though my proportion of tax I paid towards health care was not "used up", I still cano¡not say my children are entitled to it because I paid for it through taxes.
Also following you train of thought, if you are long term ill, then you would have already used up more than your NI and tax contributions on your own treatment.
I am only saying this to give you an example of why you cannot say that your children are entitled because you paid for it for X number of years as a UK tax and NI payer.

We are quite a mixed bunch on here, we are jack of all trades master of none.
Most of us on here dont really care either way what the ruling is, we all have our own issues.
If someone like you, who has all the fact, figuers and ruling to hand doesnt know, do you really expect us to.
We are more little bit of this little bit of that type posters, but I have noticed that most of your post seem to be related to this one subject.
Are there no other forums where this could be discussed without distractions.
After all I can understand the posts from UK taxpayers questioning the wisdom of paying benefits to people who choose to leave the UK to live a life in the sun.
Especially now that the UK on the wohole is suffering and cust will have to be made.
I am sure a lot on here would think that paying benfits abroad is a good place to start the cuts.
Most of us on here dont really care either way what the ruling is, we all have our own issues.

It does not work like that, people do not pay for themselves or their own "needs and rights".

Its funny, you are the only one hijacking this thread... you need to stop listening to whispers.
My personal opinion is that I find it very distasteful that taxes paid in the UK go to benefit someone living it up in Spain... just like I feel that heating allowances paid to people in Spain is wholly wrong.

Heating Allowance is paid to the pensioners who have paid into the UK system all their lives, longer than you, so are more than entitled to heating allowances. I assume you have never been to Spain, or anywhere out of the UK for that matter. If you had then you would know that Spain is bloody cold in the Winter months. Have you ever heard of the "Sierra Nevada", it´s a big mountain with snow all over it and people ski and snowboard their. And here is a bit more education for you, SNOW IS COLD.
But as I live in the south, but can still see the snow in the distance, I just lay about all day on the lovely HOT beach, drinking Sangria and living it up and YOU are paying for it. Shame I know. So if thats what you want to believe then go ahead Mr Hijacker.
