Brits win capital gains rebate in Spanish court ruling
Around 10,000 Britons who were illegally overtaxed by the Spanish government when they sold their properties in Spain are in line for rebates averaging £14,500 following a court ruling.
In a landmark victory for a British couple, it was ruled that a 35 per cent capital gains tax charge for non residents contravened EU rules and must be repaid, with 6 per cent interest.
If you feel you have a claim that you were over taxed when you have sold a Spanish home and you were a non resident. See here....

So now HMRC will be on their case as the difference in CGT is payable to the UK and it was 40% at that time. I think this will turn out to be a hollow victory.

Isn't CGT paid at the marginal rate of income tax? So it is 40% if you are a 40% tax payer only.
