Assaulted and then denounced for it
 
I am really worried about a situation that happened to me recently. I was out one night with friends when someone started having a go at me and saying that I had been saying things about them. This girl (clearly off her head) was screaming at me very aggressively. I was completely shocked and just responded by saying that I really didn't know what she was talking about and that I hadn't said anything about her at all. I stayed in the bar where I was, as I was concerned about being verbally attacked in such a way and didn't want to walk out on my own in case she was still around, so I waited to see if I could get a lift home from a friend who worked there. About an hour later, I couldn't see the girl who verbally attacked me, so I thought it was safe to go outside to have a cigarette. All of a sudden, this girl has stormed over to me, thrown her drink in my face and started shouting at me again. In shock, I jumped up. I responded to her again saying that I didn't know what she was talking about and she started going crazy, hitting me and punching me., breaking my glasses and cutting my nose. She still had a glass in her hand and tried to ram it into my head (giving me a very nasty bump on my forehead). I had my hands in front of me the whole time to try to stop her from hitting my face and had my eyes closed. I was just screaming at her to stop. She then must have thrown the glass at me as I felt it hit my hand and heard it shatter, cutting my finger. At this point, I have felt her back off, so I have taken that as my chance to get away. Once a friend had driven me home so that I was safe, I have called the security of the complex and they advised me to go to the medical centre to get checked out, and then to denounce my attacker at the Guardia Civil. When I got there, I find out that she has denounced me as she has a cut on her face and saying that I picked up a broken glass from the floor and threw it at her! This is a complete lie, but I am now having to go to court to defend myself, when I am the victim of a nasty and unprovoked assault. I then received a message on Facebook from this girl afterwards, pretty much threatening me, which I have also shown to the Guardia Civil, which is reported in my statement.

I was wondering if anyone can give me any advice? I have got a Lawyer, but what usually happens in theses sorts of cases in Spain? My Lawyer is obviously preparing me for the worst and explaining what could happen, as the problem is that there were no witnesses (well, there was one, but it's a friend of my attacker and I haven't been able to find out who she is). This whole situation has been really distressing and caused me a huge amount of anxiety. I have moved away from the area due to fear for my own safety and really struggle leaving my home on my own in case someone attacks me again. I know I have to see how everything plays out, but I just find it highly unfair that I am having to go through all of this when I was the victim of an aggressive and unprovoked assault. Has anyone else here been through this sort of thing, and if so, what was your outcome?

Your friends and the pub staff will be able to confirm this

Did no one else witness the second altercation?

There was only one girl who witnessed this and she was screaming for my attacker to stop. However, I have tried finding out who this girl was (I had never seen her before) and have been unable to.

My friends left before all of this happened and the bar staff were inside, so didn't see anything

It seems you have no witnesses and she has one? I would go back to the bar and ask any regulars if they can help.

When it goes to court it seems likely you may be found guilty. What punishment has your abogado said you may face if convicted?

Often complainants do not turn up at court and the case is dismissed. Hopefully that will be your experience.

If you were outside the club, there is a very good chance that there will be CCTV available either from the club or outside..... If not of the incident, possibly of the person prior to it, and their demeanor. Has this been asked?

2 questions, how did the girl have your details to denounce you? Did she just denounce an unknown person? I am not knowledgeable of how the system in Spain works. Secondly how did this girl have your details to message or post on your Facebook?
Sorry but you also start by saying you were out with friends? When this girl first became verbally abusive were you with friends? If so they can at least witness her verbal assault and demeanour at that time.

My wife was attacked by a 70 year old neighbor with a metal walking stick.
We had asked him to remove the 800 kilos of building rubble that he had dumped on our garden.
There was blood running down her neck and she had to go to hospital. We denounced him. We have a witness who gave evidence at the trial. In the UK this would have been actual bodily harm ABH.

We won the trial and the neighbor was found guilty.
He did not bother to go to the trial.
He was fined 100 euros.

So if that is anything to go by you can do whatever you like.
Just go and hit someone round the head with a stick and you are only fined 100 euros.

So even if you are found guilty nothing really will happen.
