Application for residency
Does anyone know if married couples/ civil partners can apply together for residency or if they have to apply as separate individuals? Thanks.

if so, you don't 'apply for residency' - you register as resident, and you each need to register individually

Thanks for the speedy response, Lynn. We are both EU citizens and from what you say we need to register individually. I had hoped it would be a joint thing given shared finances, assets and the like. I suppose it's yet more photocopying to be done. Thanks again.

Hi there, about this applying for residency lark. We are moving out there in January and will be applying for residency. I will be working out of country for more than 183 days, work in oil and gas, but my wife will not. Does this mean I will be liable to full Spanish tax because my wife will be a permanent resident and I will not? Thanks in advance for any replys.

If you live in Spain for more than 90 days in one go, then you should register as resident (you don't apply but simply register).
If you live in Spain for more than 182 days in any calendar year then you are considered tax resident. In your particular case, I would suggest that the over-riding factor will be that your family (wife) lives in Spain and so you will be considered tax resident even though you may not meet the 182 day rule.

tax is more complicated & totally separate, but Spain would consider you to be tax resident if you are financially supporting your wife here
therefore you would have to submit tax returns & if tax was due, then pay it to Spain
if you have already paid tax in a country with a dual tax agreement with Spain then you don't pay it twice - but you still have to declare all your worldwide income, & if the tax rates are different & you'd be paying more here, you pay the difference to Spain
