any suggestions please, i am going maddddddddd...
bought a peice of land next door to our villa about 5 years ago for about 11.000 euros, sold it for double.
just payed my non resident tax in spain to our solicitor who then said..... "oh, have just heard fm the tax office, they said the land that you sold was worth MORE... 135.000 euros and you now have to pay tax on it , 10.000 euros ?????????
to be honest with you I just cannot afford it..... surely this is wrong.........

135,000€ sounds a lot, but it would depend on location and how much land? Do you have any information relating to other sales of land in this area. Your solicitor should be able to advise you and it seems he has not? I would look for a.n.other.
I would guess tax office suspect you were paid more and did not declare black money. Difficult to prove you were not.

the land was just 1.600 metres, that cannot be built on with lots of pine trees, well away from the village in the country. I dont know how they came up with that figure. if i didnt pay it would i be in real deep s...t ?? we have put our house up for sale and would it be fair to say that we could pay this tax bill when we sell????

I cannot believe 1,600 sq metres of rural land would be worth 135,000€. I am no tax expert but I suggest you need to consult someone who is.

I would suggest visiting a gestor in Barxeta to ask for help in this matter. If the land is rustic it cannot possibly be correct. Not sure but I think you can see the price of different types of land in your locality on www.idealista.es.

If you can prove that the sale was an honest one, at the time at a price most people would have been happy to get, and to someone you formerly didn't know, or a neighbour who made you an honest offer. Not, for example to a relative. And if your bank and your 'behaviour' shows no significant increase in fortune above and beyond what would be expected (that is to say if you are truly honest) you should be able to get a Spanish speaking English lawyer to argue on your behalf. Even if you only go so far as a solicitors letter, I certainly wouldn't 'roll over' if I knew I had right on my side. But as whitelinen said, a gestor should be your first call.
