Logistics of changing E3 employer from outside the US?
Hi all,
I am in the USA on the E-3 and I am in the process of changing employers.
I need some help deciding whether to change status via USCIS or hop out of the USA briefly to get a fresh E-3.
The fresh E-3 looks like the quickest, which is perfect, but I have two concerns:
1) At what point does one resign when going the fresh E-3 route?
I need to give four weeks notice to my current employer and I'd rather not say anything at all until I'm sure I'm allowed to work for the new company. Is it possible for me to leave the USA, get my fresh E-3 approved and stamped in my passport, re-enter on my original E-3, resign and serve my last 4 weeks, then simply start working for the new employer?
2) My other concern is, I have a dependent and I'm wondering how me getting a fresh E-3 will impact their current job. Do they have to quit and go through 3 months of waiting for an EAD again?
Is it true that both of these are non-issues if I stay in the US and change status via I-129?

I think I may have found an answer to #1 after a lot of searching. This post seems to say it should be OK, one way or another, to finish work for my old employer after I get my new visa:

I can't find anywhere else that confirms it though; official or otherwise.
Would really appreciate any info from anyone who's changed employers on the E3!
