Affidadavot opf support with H1-B

Default Affidadavot opf support with H1-B

Hi , I'm on H1B visa living in Texas . My wife just got her US
Citizenship certificate and now US citizen. She is applying I-130 for me
and concurrently i'm aplyying for I-485. My wife no longer worked in
last 4 years now. In 2004 TAX return her total income was less > 10,000.
In 2005 last year we filed TAX jointely our TAX return. Can she be the
Sponsor in "affidavit of support " document or do I have to find someone
else as a "Sponsor" in Affidavit of Support document ? Becuase on our
last year TAX retrun can my wife be the sponsor however her 2005 income
was zero . ? Can my mom ( US citizen) in Texas be a Sponser on Affidavit
of Support document only

She has no choice. She MUST complete the I-864 on your behalf. If she cannot fulfill the financial requirements you have the option of completing form I-864A and using your income along with hers as you have lived in the same household for six months or more.

And yes, in case they haven't lived together six months or more, the OP's USC mother can be a joint sponsor, as long as she meets the income requirements for her household plus the immigrant.

Thanks guys. One last question. when i apply for I-485 along with my
wife applying for I-130, does both of them goes to the same mailing INS
Chicago location or does I-130 goes to Texas INS location ?

as i have downloaded the full I-485 package which has the I-130 in it

Everything goes all at once to the Chicago lockbox, including your medical, and I-864....plus the I-765 for EAD, and I-131 for AP (if you are filing those).

You need to go slowly and carefully to make sure you find all of the instructions:

I'm only applying for I-130 and I-485 right now. and i checked in the
package , its says, mail the package to the INS where applicant is
residing , which is Texas. I plan to use my H1B till the time i get the
I-130 & I-485 approved.

I'assuming aftering getting the approval, I will get my GC in mail or do
i hv to apply a for a GC after getting the approval for both of these
application ?

Along with these two forms, you'll also need to send the I-864 Affidavit of Support, and your full medical (in a sealed envelope). And, of course, whatever other backup those forms call for.

The "package" whatever you're looking at, is wrong. Look at www.uscis.gov for the mailing address your AOS package should go to, in Chicago. Sometimes forms instructions don't get updated as fast as the information on line.

First you'll receive a notice to go for fingerprinting. Eventually you and your wife will be called to appear in person for an interview at your local office, where you will also show evidence of your married life together. That is where you will get approved (or not) for your GC. Even if all is well with your case, it might be delayed due to pending security checks. If all does go well and you get approved on the day of your interview, your GC should come in the mail after that. You can look again at www.uscis.gov to find approximate processing times for the I-485 at your local office.

SN: Look at the link I posted for you. The instructions ON the forms are WRONG. You must ALWAYS look at the uscis.gov page for the correct FEE and MAILING info.
After you send in your petition and application, you will eventually be called for an interview. If you pass the interview, the officer will grant you permanent resident status and your Green Card is mailed to you.
