mmm. quick question:
1) lamps. will ones from the uk work over here. if i stick a new plug on them? i can't see why not.

2) working. my wife will be on h-4. which means no working. but. can she do "e-work" for a company based in the uk if she's paid into a UK bank account. ie she's a self-employed consultant based in the UK being paid by a UK firm into a UK bank but working within the USA.

why bother, a lamp will cost $8 from Walmart. (and I'm sure without transformers and sh*t, you can't just stick a new plug on it...........)

You might have more luck getting answers to Q2 in the US Visas or US Immigration forums on British Expats.

Also, an employer is probably sponsoring you to come and work in the USA. Why can't you ask your employer for the answer to Q2?

You might also know that on an H visa you will be filing US resident taxes, meaning that you have to declare UK income as well. I think that your wife may still be required to file, even if you file taxes separately.

well exactly, and the red flag will be flying if you lead a $100,000 a year lifestyle on $50,000 a year wages.

There was a case on here where a guy worked at walmart, as he'd just sold his house in the UK, and had $500,000 in the bank from the sale of his house and started buying rental properties.

The IRS seized his assets until he could legitimately verify where his money was coming from, as they knew he couldn't afford this stuff on Walmart wages.

We asked question 2 of our immigration lawyer (highly respected, top immigration lawyer) and the answer is just what others here have told you; no work means no work.

My wife is on an H4 and was offered a consultancy job for a company based in Europe and doing business exclusively within Europe. They wanted her to work on their project on an online-only basis. Our lawyer's response: she would have to leave the US to do the job, since her visa states that she may not undertake ANY paid work whilst resident here.

You may not like the answer (hell, we certainly didn't) but it's a fact. Nobody likes to hear what they don't want to hear, but at least you're getting some straight answers.

outta curiosity.... if the wife crossed the border into Canada every day to work, would that be allowed? eg working whilst physically in another country? or do you have to forgo ALL work, no matter where it is performed, in order to legally reside here on an H-4?

Point is is it the act of work performed whilst physically in the US, or work performed *at all* while living in the US on an H-4 visa?

IOW, could she fly back home and work a temporary assignment?

Seems to me it doesn't matter how you do it - telecommuting to Europe, risking pirates in open waters, or working for undeclared cash in the back of a restaurant (even with a US passport): you're still hoping to avoid discovery because you'll owe something to somebody.
