(NB: in any event, the 10 year ban doesn't make sense given the time-scale of the overstay - there *must* have been something else...)

(1) INS no longer exists - it is USCIS
(2) USCIS has no heart, no soft spots, no compassion - they apply immigration law as they see fit.
(3) Just because you had a 'nice' adjudicating officer who you *thought* was giving you special treatment because he could see how lovey-dovey you and your spouse were, doesn't mean that (a) your perception is correct, and even if it was, (b) it would be highly unwise to generalise based on your experience .
To recap: the OP should do *nothing* without first speaking in confidence with a qualified immigration attorney. And he should d so well before his I-94 runs out.

I think if USCIS had had a change of policy and decided the VWP express was now not a good idea, we would be hearing things about it on this board by now. Well, unless they're deporting them in secret in the middle of the night and cutting their tongues off so they can't talk.

I'm with you. The story is very detailed until it comes to the reason why they deported her. Then there is absolutely nothing: no paperwork, no reference, no no nothing. DHS might be almost above the law, but probably haven't quite managed such a totalitarian stance, yet.
