Re: EAD no longer required for L2 holders

And here is the policy alert (https://www.uscis.gov/sites/default/files/document/policy-manual-updates/20211112-EmploymentAuthorization.pdf).

I think the fact that L2 spouses are considered...

Re: Adjustment of status through family sponsorship after overstay

This is incorrect. According to the BIA decision in Matter of Arrabally (https://www.justice.gov/sites/default/files/eoir/legacy/2014/07/25/3748%20%28final%29.pdf) (2012), departure on a grant of...

Re: Adjustment of status through family sponsorship after overstay

You are in the Immediate Relative category (spouse, parent, or unmarried under-21 child of US citizen), and as such your eligibility for Adjustment of Status is not affected by being out of status at...

Re: I-407 (Abandonment of Green Card) Termination Date as LPR

It seems you are talking about when you cease to pass the Green Card Test for US tax purposes. The IRS Publication 519 section on the Green Card Test has more on this. Basically it says that your...

Re: Working when Citizenship is delayed

Although the I-9 does not ask for a date of expiry for a permanent resident, the issue of document reverification is more complex. See the section...

Re: Working when Citizenship is delayed

Your permanent resident status does not expire, even if the card expires. You retain the right to legally work and live in the US indefinitely. If you completed the I-9 with a (2-year or 10-year)...

Re: Travel Question during divorce

However, they are interested in whether the spouse comes to the interview if there is one, and the OP said their spouse will not come to the interview. So if they are called for an interview (or if...

Re: Travel Question during divorce

Yes, your expired green card plus extension letter are valid for you to come back to the US.

It is also possible to file a Removal of Conditions from abroad, so even if for some unlikely reason...

Re: Tasks after green card?

Yes, you should apply for the children's SSNs, so that you can claim the Child Tax Credit for them when you do your taxes. You and your spouse can also update the SSA with your statuses, so you can...

Re: E2 Visa Process

US visas are solely for entry; expiry doesn't matter to someone who is in the US. Do you mean their E2 status (as given on their I-94) expired? What is this "extension application" you are referring...

Re: Has anyone extended their I-94 at the border?

I think you are confused about something very basic. Extension of stay extends your status, i.e. when approved, it grants you a new I-94, which is the same thing that would be accomplished if you...

Re: Has anyone extended their I-94 at the border?

Then your husband would file the I-129 himself for Extension of Stay. Your statement "an extension of stay is not possible for us" does not make any sense. All of you can apply for extension of stay...

Re: Has anyone extended their I-94 at the border?

Why not? Your husband's employer can file I-129 for Extension of Stay for him, and you and the kids can file I-539 for Extension of Stay based on that.

Re: Has anyone extended their I-94 at the border?

But the same thing is true if you leave and re-enter and get admitted for a new period -- after your visa expires, as soon as you exit the US, you will need to apply for a US visa before you can...

Re: Has anyone extended their I-94 at the border?

What does "our i94 needs to be extended before our visa expires and leaves us ‘landlocked" mean? If you leave and re-enter the US on your visa now, you will be admitted for a new period of stay, but...

Re: IR-2 for child under 18

How close is she to 18? She has to get the immigrant visa and enter the US with it before her 18th birthday for her to automatically become a US citizen under INA 320. If she doesn't enter until...

Re: Applying for an ESTA (overstayed visit visa as a minor)

You are not clear about what status you were admitted on in the time you overstayed. If you overstayed the Visa Waiver Program, by law you are ineligible to use the VWP ever again. If you overstayed...

Re: F2A AOS CSPA fun!

Prior to 1986, fraud at entry did not cause a ban (it only made one inadmissible at the time of that entry, but it didn't make you inadmissible for any period of time). This was amended in 1986 so...

Re: F2A AOS CSPA fun!

Why is that relevant? The OP's parents are in the US. (Not to mention that they do have proof of permanent residency.)

Re: F2A AOS CSPA fun!

If the F2A category remains current indefinitely, then as long as your parent files the I-130 before you turn 21, and you seek to acquire the visa within 1 year of it becoming available, you will not...
