There are several issues here:

- if you live in Australia an RRV is a formality as you would meet the 2 year residence requirement. If you live overseas, you need to demonstrate that you continue...

Sounds like he travelled without any visa and was granted a border visa.

It will ultimately depend on the specific circumstances, but it’s unlikely to be a major issue.

He can’t travel to Australia until his permanent visa is granted (or he gets a travel exemption). RRVs are taking approximately 3 months at the moment.

They don’t usually ask for police checks for RRV applications. I would only supply if asked.

As you say, evidence of substantial ties to Australia, which are of benefit to Australia, is required....

To be pedantic, you can’t hold both a 309 and a 100 visa, but either will get you into Australia and onto a plane with no additional paperwork.

You are eligible for the permanent (subclass 100) visa 2 years after you submit the initial combined 309/100 application. This also takes time to process. As Tee says, processing times are even more...

If he really has no substantial ties to Australia, then the best he will manage is a three month RRV if he has compassionate and compelling reasons for his absence. So, he needs to be mindful of that...

I really don't think an appeal is warranted in this situation. Just declare the refusal on future applications and, if required, explain the circumstances. It is not a huge issue.

Definitely only deal with an actual MARA registered agent, as some firms 'hijack' legitimate agent's MARNs. You cannot be a member of the MIA if you are not an RMA.
