Yeah, the EU needs to fix this. It's their responsibility. But not if it means the member states on those borders are obliged to cooperate. That would be imposing its will on sovereign nations.

First, "EU law" is a bit of a misnomer. Common law was agreed to and implemented in member state's law. Willingly. And for good reason. But that's a different argument.
